By deleting the table of wage rates in clause I 0( I ) and insening the following in lieu thereof:- ..Classification Arbitrated Southern Division Base Rate Safety Net Eastern District Per Wee k Adjustments Per Week $ $ $ Process Employee - Level I 389.50 24.00 413.50 Process Employee - Level 2 379.30 24.00 403.30 Process Employee - Le,·el 3 375.00 24.00 399.00 Process Employee - Level 4 36860 24.00 392.60 Proces, Employ~e - Level 5 344.60 24 .00 368.60 The rates of pay in this Award include the first. second and third $8 per week arbitrated safety net adjustments payable under the November 1994 State Wage Case dec1s1on and the October 1995 State Wage Case decision. Increase-, made under previous State Wage Case principles or under the current Statement of Principle.s are not to be u~d tO offset arbitrated safety net adjustments. Pre February 1992 overaward arrangements are to be applied according to their tenns.". 2. By inserting a new clause 25 a~ follows:- "2.5 An ti-Discrimination (I) It is the intention of the panics to t hi s Award to achieve the principal object ins. 3(k) of the lnd11strial Relations Act 7990 by helping to prevent and eliminate discriminati on on the basis of sex. marital Status. pregnancy. pare ntal status, age, race. impairment, religion. pol it ica l belief or activity, trade union activi ty, lawful sexual activity. and association wit h. or relation to, a person id entified on the ba~is of any of the above attributes. (2) Accordingly. in ful fi lling their obl igatioM under the disputes avoidance and settli ng clause, the parties to the Award must make every endeavou r to ensu re that nei ther the Award provisions nor their operation are directly or indirec tl y discriminatory in their effects. ( 3 ) Nothing in this clause is to be taken to affect - (a) any di ffere nt treatment (or treatment hav in g different effects) which is specific al ly exempted under the Ami-Discrimination Act 1991; (b) an employee, empl oyer or registered orga nisation, pursuing mal1ers of discrimination, including by appl ication to t he Human Rights and Eq ual Opportunity Commis.5ion/Anti-Discrim.ination Comm iSsion; (c) the exemptions in ss. 29 1(3)(a) and (b) of the Ac t ".
