No. 119/2003 Fair Trading Act 1999 Fair Trading (Amendment) Regulations 2003 The Lieutenant-Governor as the Governors Deputy with the advice of the Executive Council makes the following Regulations: Dated: 7 October 2003 Responsible Minister: JOHN LENDERS Minister for Consumer Affairs SUDHA KASYNATHAN Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Fair Trading Regulations 1999 to prescribe a lay-by cancellation form for the purposes of section 85(1A) of the Fair Trading Act 1999. 2. Authorising provision These Regulations are made under section 165 of the Fair Trading Act 1999. 3. New regulation 7(3) inserted After regulation 7(2) of the Fair Trading Regulations 19991 insert— "(3) The form for the cancellation form under section 85(1A) of the Act is Form 3 in the Schedule.". 5. New Form 3 After Form 2 in the Schedule to the Fair Trading Regulations 1999 insert— "FORM 3 LAY-BY CANCELLATION FORM Fair Trading Act 1999 Section 85(1A) Details of lay-by (to be completed by the supplier) Name of supplier: Address of supplier: Date of lay-by: Lay-by identification number (if any): Description of goods: Total payments Cancellation fee Refund/amount made to date: (if any): due: $ minus $ = $ Name of purchaser: Signature of purchaser: Date: Return this signed form to the supplier's address given above". ═══════════════ r. 4 -- 3 of 4 -- Victorian Legislation and Parliamentary Documents S.R.
