No. 89/2003 Fair Trading Act 1999 Fair Trading (Safety Standard) (Bunk Beds) (Amendment) Regulations 2003 The Governor in Council makes the following Regulations: Dated: 22 July 2003 Responsible Minister: JOHN LENDERS Minister for Consumer Affairs HELEN DOYE Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Fair Trading (Safety Standard) (Bunk Beds) Regulations 2002 to exempt certain classes of bunk beds from the prescribed safety standard for bunk beds. 2. Authorising provisions These Regulations are made under sections 34 and 165 of the Fair Trading Act 1999. 3. Safety standard not to apply to certain bunk beds For regulation 4(2) of the Fair Trading (Safety Standard) (Bunk Beds) Regulations 2002 1 substitute— "(2) For the purposes of section 33(1) of the Fair Trading Act 1999, AS/NZS 4220:1994 is the prescribed safety standard for bunk beds -- 2 of 4 -- Victorian Legislation and Parliamentary Documents S.R. No. 89/2003 Fair Trading (Safety Standard) (Bunk Beds) (Amendment) Regulations 2003 2 supplied as an item of furniture or part of an item of furniture, other than— (a) portable bunk beds designed for camping; and (b) bunk beds that are built-in fitments in caravans, camper trailers, tent trailers, camper vans, motor homes, trains, ships, aircraft and other types of conveyances.". 4. Statute law revisions (1) In the heading to regulation 4 of the Fair Trading (Safety Standard) (Bunk Beds) Regulations 2002, for "to" substitute "of". (2) In regulation 4(3)(e) of the Fair Trading (Safety Standard) (Bunk Beds) Regulations 2002— (a) for "(a)" substitute "(i)"; (b) for "(b)" substitute "(ii)". ═══════════════ r. 4 -- 3 of 4 -- Victorian Legislation and Parliamentary Documents S.R.
