Gaming No. 2 (Bingo) (Amendment) Regulations
2003
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to amend the
Gaming No. 2 (Bingo) Regulations 1998 to—
(a) revoke references to "notional receipts";
(b) prescribe a condition of a permit that
provides that the maximum amount that can
be paid as prizes in a session of bingo is 90%
of the gross receipts;
(c) prescribe the amount the permit holder may
incur as expenses of bingo;
(d) prescribe how the fee payable to an operator
is to be determined under section 26(2)(e) of
the Gaming No. 2 Act 1997;
(e) prescribe the period and the time limit for
returns by an operator under section 47 of
the Gaming No. 2 Act 1997.

2. Authorising provision
These Regulations are made under section 105 of
the Gaming No. 2 Act 1997.
3. Commencement
The Regulations come into operation on 1 October
2003.
4. Principal Regulations
In these Regulations, the Gaming No. 2 (Bingo)
Regulations 19981 are called the Principal
Regulations.
5. Amendment to Regulation 4—Definitions
In regulation 4(1) of the Principal Regulations, the
definition of "notional receipts" is revoked.
6. Amendment to Regulation 7—Sessions, premises
etc.
In regulation 7(1)(d) of the Principal Regulations,
for "notional" substitute "gross".
7. Amendment to Regulation 10—Prizes
In regulation 10(1)(b)(ii), (c)(ii) and (d)(ii) of the
Principal Regulations, for "70% of the notional
receipts" substitute "90% of the gross receipts".
8. New Regulations 14 and 14A
For regulation 14 of the Principal Regulations
substitute—
"14. Prescribed expenses
The prescribed amount which the permit
holder may incur as expenses of bingo in
relation to each session of bingo is—
(a) if the session is in a rolling jackpot
sequence—60% of the amount
remaining after deducting from the
gross proceeds for that session the

amount paid into the jackpot pool for
distribution as prize money in a later
session in a rolling jackpot sequence, or
(b) in all other cases—60% of the gross
proceeds of the session.
14A. Agreement between permit holder and
operator
For the purposes of section 26(2)(e) of the
Act, a fee is chargeable only if the agreement
does not require the permit holder to provide
any assistance in the conduct of sessions of
bingo authorised by the permit or any
assistance in the operation of the bingo
centre for any purpose.".
9. New Regulation 17
After regulation 16 of the Principal Regulations
insert—
"17. Returns
For the purposes of section 47 of the Act—
(a) the prescribed period is a financial year;
and
(b) the prescribed time limit is 3 months,
ending on 1 October each year.".
