Rl2-/0o/!990J MOTEL I~ I> USTRY AWARD - SOUTHERN DI VISION (EASTERJ\ DI ST RI CT) COMMISSIONER BOUGOURE 9 November 1995 VARIATION THIS matter coming on for hearing before the Commission at Brisbane on 9 November 1995 , this Commission dolh order that the sa id Award be varied as follows as from the thirteenth day of November 19 95: - In clause 5 (Wages) - (a) by deleting subelause (I) and inserting the fo ll owing in lieu thereof:- "5 .( I) Subject to clause 4A hereof. the following shall be the minimum weekly rate of pay for adult employee s: - The new classifica ti on structure expresses the interim total rate payable. being the combination of the base rate. the first minimum rates adjustment an d the First and Second $8.00 Safety Net Adjustments. such adjustments are to be absorbed into overaw,ird payments where such payments are being made. ·overaward Pavment • is defined as the amount (whether it be tenned ·overaward payment', ·attendance bonus', ·service increment· or any Lenn whatsoever) wh ich an employee would receive in excess of the 'Award Wage· which applied immediately prior to the date of operation of any minimum rates adjustmen t awarded by the Commission for the classification in which the employee is engaged: Provided that s uch payment sha ll exclude overtime shift allowances. penalty rates, allowances, fares and trave ll ing time allowances and any other ancillary payment of a like natu re prescribed by this Award.
