Queensland Branch, Union of Employees AND Queensland Catho li c Educat ion Commission (No 8594 o//995) CAT HOLI C BOARDING SC HOO LS AN D COLLEGES EM PLOYEES SOUT H-EASTERN DIVI S IO N INDUSTRIAL AGREEMENT COMMISSIONER BLOOMFIELD 8 August 1995 VARIATJON THIS matter coming on for hearing before the Commission at Brisbane on 8 August 1995, this Commission doth o rd er that th e said Agreement be varied as from the fourteenth day of August, 1995:- 1. By inserting a new clause 16A (TUTA Leave) as follows : "TUTA Leave I 6A( I ) Upon written app li cation by an employee to an employer such application being en dorsed by the Union and giving to th e employer at least two months notice. s uch emp loyee may be granted up to three working days leave (non-cumu lative) on ordinary pay 10 attend courses and seminars conducted by the Australian Trade Union Train in g Authority (TUT A). For th e purposes of th ese provisions 'o rdinary pay' shall mean at the ordina ry rate paid to the emp loyee exclusive of any allowance fo r travelling time and fares. (2) The granting of such leave shall be subject to the following condit ons:- (a) An employee must have at least two years uninterrupted service with the employer prior to such leave being granted. (b) Th is clause shall not apply to an employer with less than three employees bound by this Agreement. (c) The maximum number of employees of one and the same employer attending a TUTA cou rse or seminar at the same time shall be as follows: Where the employe r employs be tween 3 and 8 emp loyees Where the employer employs more than 8 employees 2 Provided that whe re the employer has more than one place of employment in Queensland, then the fommla shall apply to the number of employees employed in or from each place of employment. (d) The granting of s uch leave shall be subject to the reasonab le convenience of the employer so that the operations of the employer will not be unduly affected. (e) No emp loyee shall be granted leave exceeding the duration of the TUTA cou rse or seminar to be attended. (f) No emp loyee shall be granted a second or subsequent period of leave prior to the expiration of eighteen months from the date of commencement of the last period o f such leave granted by the emp loyer. (g) The scope, content and grade of the course or seminar shall be such as to contri bute to a better understanding of industrial relations within the employer 's operations, and in parti cular, a better understanding of the Award and Industrial Agreements and industrial issues impinging upon the professional life of employees in the non-Government sector. (h) In granting such paid leave, the employer is not responsible for any additional costs except the payment of extra remuneration where relieving arrangements are instituted to cover the absence of the employee. Such paid leave will not affect other leave granted to employees under this Agreemen t.
