Other courses mutual ly agreed be tween a Union party w th is Award and an emp loyer. or emp loyers. mar be included un der th is clause. Any wrillen appl ication by a Un ion seeking release o f a delegate or representative to attend a co m~ e shall include de tails of the type and co ntent of the cou rse 10 he anen ded as wel l as the dates upon wh ich th<.: co urse is proposed to be condu<;t<::d . For the purposes of these prov isions ·o rdi nary pay· shall mean the ordinar) ti me earni ngs pa id to the em pl oyee exclusive of any a ll owan ce, . pena l! ~ rate, 0r trm c lling time and fares. (2) The granling of such leave shall be subject to the followin g co nditions:-- (a) The emp loyee m ust have at least twelve month s continuous se rvice with the emp loyer prior to such leave being granted and be the elected lln ion delegate/rep resentative. (b) Unless otherwise ag reed the maximum number of e mployees of one and the same employe r attending a training course or se minar each year will be as follows:- (i) Where ihe employer emp loys hetween I 0 and 50 employees (i i) Where the em ployer emp loys het \\een 51 and I 00 emp loyees ( iiij Where the employe r emp loys over 100 e mpl oyees 2 4 (c) Where an emp loyer has more than one pl ace of employment in Queensland then the max imum nu mher of emp loyees e ntitled to allend a course al the same time shall he two. This s hall not prevent an emp loye r from ag reeing 10 release additional empl oyees. (d) The granti ng o f such lea ve sh all be su bj ect to the convenience of the e mployer so that the o perat ions of the Enterprise wi ll nol be adversely affected. Where an employer approaches the Union and demons trates genuine difficulties wi th respect to the release of a particular union de legate or representat ive at a particular time ( inclL1 di ng where the employer mi ght have previously ad ,•iscd of its ability lo release such Union delegate or repres entative) 1.he Un ion wil l not u nreasonably press its r equest for the rel ease of t hat delegate /representative at that time. If the mauc r is not amica bly reso lved, ii shall be processed in accordance with the Dispute Procedure co ntained in this Award. (c) In granting suc h paid leave, the emp loyer is not responsible for any add itiona l costs excep t the paym ent of extra rem uneration whe re rel iev in g arrangements arc insli tuted by th.: empl oyer to cover the absence of the employee. ( I) Leave granted to attend such tra in ing co urses will not incu r any additional paymem or altemate l ime o ff if' such co urse co incides with an employee's da y off in a l 9 day month workin g arrangemen t. or with any ot her con cess iona l leave. (g) Such pa id leave will not affect oth er leave granted to emp loyees under this Award. ( h) O n c ompktion o f the course the emp loyee shall. upon request. provi de 10 the emp loye r proof of the ir attendance at the cou rse. Except in the case of sick lea ve or o ther authorised leave. non -allcn da nce at a tra in ing course will result in the emp loyee nol bein g paid for such li m e.'' .
