VARIATION
TIIIS matter coming on for hearing before the Commission at
Brisbane on 3 July I 995, this Commission doth order that the said
Award be varied as follows as from the nineteenth Jav of June and
the third day of July, 1995:- ·
By deleting suhclause (I) of claus~ 3 .3 (Wages) and mseriing the
following in lieu thereof:-
"( l )Subject to clause 3.2 hereoC the minimum rates of wages
payable at the following classifications shall be:-

Wage Case. Consistent with the requirements of that
principle the two $8.00 Safrty Net Adjustments arc
ahsorhahle to the extent of any equivalent amount in
rates of pay - whether overaward, award, industrial
agreement or certified agreement - m e>;cess of the
minimum rates ( classification rate and supplementary
payment) prescribed in accordance with the October
1989 State Wage Case decision ,md adjusted in
accordam:e with the July 1991 State Wage Case
decision.
Uveraward Payment Overaward payment i,
defined as the amount in rates of pay which an
employee would receive ill cxccss of the minimum
award wage as prescrihcd in this Award for the
classification in which such employee is engaged
which applied immediately pnor to the date of
operation of this Yariation:
Provided that this definition shall exclude overtime,
shi/i allowances, penalty rates, cxpcnse related
allowances, industr) allowances. disabilit)
allowances, Yacation allowances, specwl rates or
allowances, responsibility allowances, or any other
ancillary payments of a like nature ckscribed by this
Award.

applying before the application of the two $8.00

Note .J: The Award rate referred to above is payable in respect et
ordinary time earning, from 19 June 1995 and for all
purpo,es from 3 July 1995, Overtime worked bet\\een
19 June 199:- and 2 July 1995 inclusi\·e shall he
calculated as a mulliple of the Award rate applicable
immediately prior to l 9 .lune 1995.''.
