THIS matter coming on for hearing before the Commission at
Brisbane on 3 July 1995, this Commission doth order that the said
Award be varied as fo ll ows as from the nineteenth day of J une and
the third day of July, 1995:-

fo llowing in lieu thereof:-

Note 1: The Award rate includes wage incrca5cs and adjustments
aris ing from the State Wage Case decisions colloquially
referred to as: 2nd Tier Adjustment; 1st (two parts) and
2nd Structural Efficiency Adjustments and Safety Net
Adjustment and the first and second $8 Safety Net
Adjustments.

Note 2: The supplementary payment at each classification level
includes the two $8.00 arbitrated Safety Net
AdjustmentS in accordance wi th the February 1994
Review of Wage Fixing Principles and the December
1994 State Wage Case. Consistent with the
requ irements of those principles the two $8.00 Safety
Net Adjustments are absorbable to the extent of any
equivalent amount in rates of pay - whether overaward.
Award, Industri al Agreement or Certified Agreement -
in excess of the minimum rates (classi Ii cation rate and
supplementary payment) prescribed in accordance with
the October 1989 State Wage Case decision and adjusted
in accordance wiU1 the July I 991 State Wage Case
deci sio n.
Overaward Payment - 'Ov eraward ' payment is
defined as the amount in rates of pay which an
employee would receive in excess of the minimum
award wage as prescribed in this Award fo r the
classification in which such employee is engaged
which app li ed immediately prior to the date of
operation of this variation:
Provided that this definition shall exclude overtime.
shift allowances, penalty rates, expense related
allowances, industry allowances, disability
allowances, vacation allowances, special rates or
allowances, responsibility a ll owances, or any o th er
anci llary payments of a like nature desc ri bed by thi s
Award.
Note 3: The Award rate referred to above is payable in respect of
ord inary time earnings from 19 June 1995 and for all
purposes from 3 July 1995. Overtime worked between
19 June 1995 and 2 July 1995 inclusive shall be
calculated as a multiple of the Award rate applicable
immediately p ri or to 19 June l 995.".
