TlllS matter coming on for hearing before the Com mi ssion at
Brisbane on the tenth day of April, J995, and the twenty-e ighth day
of June, I 995, this Commission doth order that the said Award be
varied as fo ll ows as from the e ighth day of May, 1995:-
By de leting subclause ( I) of Clause 5 (Wages) and inserting the
following in lieu thcreof:-
"\1/ages
5.(1) Adults - The minimum rates of wages payable to adult
emp loyees shall be as follows:-
The new classification structure expresses the interim total rate
payable, being the combination of the base rate. the first and second
minimum rates adjustments and the 1st and 2nd $8.00 safety net
adjustments. Such minimum rates adjustment is to be absorbed into
overaward payments where suc h payments are being made.
·Ove raward Payment' is defined as the amount (whether it be
tenned ·overaward payment'. 'attendance bonus' , ·service
increment' or any tem1 whatsoever) which app lied immed iately prior
to the date of operation of this variation:
Prov ided that such payments shall exc lude overtime, shift
allowances, penalty rates, allowances fares and travelling time
allowances and any other anci ll ary payment of a like nature
prescribed by this Award.
The ultimate relativities for the new class ification arc as
follows :-

apply ing before the application of the $8.00 arbitrated safety net
adjustment made in accordance with the February 1994, Review of
Wage Fixing Principles.

Note The total inter im wage rate inc lu des the following wage
increases: Second T ier March 1987; the SEP October
1989 - 1st and 2nd Payments: SEA July l 99 I: and the
1st & 2nd $8 SNA.
Note The supplementary payment at each classification level
represents two $8.00 adjustments reflecting the
app lication of iJ1e arbitrated safety net adjustment
principles enunciated in the February, 1994 Review of
Wage Fixing Princ iples and the December. 1994 State
Wage Case. Consistent with the requirements of those
principles the $8.00 safety net adjustments are
absorbable to the extent or any equivalent amount in
rates of pay - whether overaward, award. in dustrial
agreement or certified ag reement - in excess of the
minimum rates (Classification Rate and Additional
Payment) prescribed in accordance with the October
1989 State Wage Case decis ion an d adjusted in
accordance with the July 199 l State Wage Case
dec ision.
