Note 2: The Award rate at each c lassification level includes $8.00 adjustments reflec ti ng t he application of the arbitrated safe ty net adjustment principle enunciated in the December 1994 Review of Wage Fixing Principles. Consistent with the tcquirernents of that principle the $8.00 safety net adjustments are a bsorbablc to the extent of any equivalent amount in rates of pay - whethe r overaward, awar d, industrial agreement or certified agreemen t - in excess of the min imum rates (baseiclassi fication rate and supplementary payment) prescribed in accordance with the October 1989 State Wage Case decision and adj usted in accordance with the Ju ly 1991 State Wage Case deci sio n. 'Overaward · payment is defined as the amount in rates of pay which an employee wou ld receive in excess of the mini mum award wage as prescribed in this Award for the c lassification in which su ch emp loyee is engaged which applied immediately pr ior 10 the date of operat ion of this va riation : Prov ided th at this definition sha ll exclude overtime, shift a ll owances, penalty rates, expense re lated a ll owances, vacation a ll owances, special rates or allowances, responsibility al lowances, or any other ancillary payments of a like nature described by this Award. Note 3: The Second $8 . 00 Safety Net Adjust ment is applicable for ordinary time purposes from 29 May I 995 and for all purposes of the Award from 3 July 1995 . Therefore, for the period 29 May to 2 Ju ly 1995 i nc lus ive, employees sha ll receive a Oat increase ca lcu lated back for ordinary time worked. Note 4: The percentage rela ti vi ties column relates to the pe rcentages applying before the application of the first and second arbitrated safe ty net adjustments .
