(5) ·Hospitality Ser\'iccs Grade 4' shall mean an employee who has the appropriate le\'cl of training and who is primarily engaged in one or more of the following:-- (a) (i) Full control of a cellar. including stock control and ordering. including the receipt. delivery and reordering of goods within such area: (ii) Designing and mixing a range of sophisticated cocktails and other drinks. May include stocktaking and ordering of stock: (iii) Supervising training and co-ordination of employees of lower grades: OR (b) Shall mean a person who has the appropriate level or training. who plans and co-ordinates leisure activities and/or organises activity programmes and ma) supervise other leisure attendants. (6) ·Hospitality Services Grade 5· shall mean an employee who has completed an apprenticeship or who has passed the appropriate trade test and who is engaged in any of the following:-- undertaking general cooking duties including a la carte. baking. pastrycooking duties. butcher. waiting. butler. (7) 'Hospitality Ser\'iccs Grade 6' shall mean an employee who has the appropriate level of training and who is primarily engaged in one or more of the following:- (a) (i) Solely responsible for other cooks and other kitchen employees in a single kitchen establishment where no other trade qualified cooks arc employed: (ii) Supervising, training and co-ordinating food and beverage staff including maintenance of service and operational standards. preparation of operational reports and staff rostcring: 0 R (b) (i) General or specialised cooking duties including the training and supervision of other cooks and kitchen staff and relieving Hospitality Services Grade 7 employees on their rostered days off or when on annual or other leave: (ii) Supervising. training and co-ordinating the work of employees engaged in the housekeeping area. ( 8) • Hospitality Services Grade 7' shall mean a chef de partie or equivalent who has completed an apprenticeship or has passed the appropriate trade test in cooking. butchery. baking or pastrycooking and has completed additional appropriate training and who perfonns any of the following:- (a) General and specialised duties including supervision or training of other trade qualified cooks. ordering and stock control: (b) Solely responsible for other cooks and other kitchen employees in a single kitchen establishment where other trade qualified cooks arc employed. (9) "Appropriate level of training· shall mean:-- (a) Completion or a training course deemed suitable according to guidelines issued through Tourism Training Australia for that particular classification. Such course to be accredited by the Australian Hospitality Review Panel: (b) That the employee's skills have been assessed to be at least the equivalent of those attained through the suitable course described rn paragraph (a), such assessment to be undertaking by a qualified skills assessor: or (c) !hat for a transitional period until l\\O )Cars after 24 April 1991 the employee is appointed in a position that the classification relates to. ( I 0) ·casual Lmploycc • shall mean an employee who is engaged and paid on an hourly basis and whose employment is subject to termination without notice and who is mually employed for less than forty hours in any one week. ( 11) •Adult" shall mean an employee of t\\Cnly-one years and over. ( 12) ·union· shall mean the Australian Liquor. Hospitality and Yliscellancous Workers Union. Queensland Branch, lfnion of f-,mployees.··. 2. By deleting subclauses (1) and (4) of clause 5 (Wages) and inserting the following in lieu thereof:-- "'5 (I) Subject to clause 4A hereof, the following shall be the minimum \\eekly rate of pay for adult employees:- The new classification structure expresses the interim total rate payable, being the combination of the base rate. the first minimum rates adjustment and the First and Second $8.00 Safety Net Adjustments. such adjustments are to be absorbed into o\'eraward payments where such payments are being made. ·overaward Payment" is defined as the amount (whether it be termed •overaward payment'. ·attendance bonus·. 'servicc increment" or any term whatsoever) which an employee would recei\'e in excess of the 'Award Wage· which applied immediately prior to the date of operation of any minimum rates adjustment awarded by the Commission for the classification in which the employee is engaged: 15148~ !.DOC 26 May, 1995] QUEENSLAND GOVERNMENT INDUSTRIAL GAZETTE 383 Provided that such payment shall exclude overtime shift allowances. penalty rates. allowances. fares and travelling time allowances and any other ancillary payment of a like nature prescribed by this Award. Consistent with the requirements of that principle the two $8.00 safety net adjustments are absorbable to the extent of any equivalent amount in rates of pay - whether overaward, award, industrial agreement or certified agreement - in excess of the minimum rates (classification rate and supplementary payment) prescribed in accordance with the October 1989, State Wage Case decision and adjusted in accordance with the July 1991, State Wage Case Uecision. ( 4) Casuals - Except as hereinafter provided, casual employees shall be paid 50% in addition to the rate of pay prescribed for the class of work that they are performing: Provided that the following classes of casual employees shall be paid at the rates set out hereunder:- Funcl!on and Food Waitresses All other Waitresses and all Waiters Housemaids .. Kitchemnaids per hour $ 10 4640 10 6865 10 3980 I O 3080 All casual employees shall be paid as for a minimum of two hours per engagement.". 3. By inserting a new clause 15E as follows:- "Enterprise Flexibility I 5E.( l) The employer and employees who have a working knowledge of the particular enterprise or workplace are, by this clause. provided with a quick and uncomplicated process to reach agreement to vary inappropriate award provisions to the mutual benefit of the employer and employees in the particular enterprise or workplace. (2) As an ongoing process, in order to promote improvement in productivity and efficiency discussions should take place between employers and employees at the enterprise or work place le,el about how the award should be varied to make the particular enterprise or v,orkplace more eflicient according to its particular needs. Industrial Organisation Officials. delegates or members at the particular enterprise or work place may take part in those discussions. ( 3) Any agreement reached between an employer and employees al an enterprise or work place level shall be contingent upon:- (a) the genuine agreement of a majority of employees affected by any proposed changes; (b) the agreement being consistent with current state wage case principles and the Industrial Relations Act I 99(); (c) the Commission being satisfied that proposed variations to the award do not disadvantage the employees who would be affected in relation lo their employment conditions; In relation to this requirement a variation as agreed disadvantages employees as to their employment conditions only if:- (A) it would result in the reduction of the employee's entitlements or protection under the award. another award or an industrial agreement; and 15148_!.DOC -- 2 of 4 -- 384 QUEENSLAND GOVERNMENT INDUSTRIAL GAZETTE [26 May, I 995 (BJ in the context of their employment conditions considered as a whole. the Commission considers the reduction is against the public interest. (d) the application to the Commission for apprmal being supported at the hearing hy documentation appropriate to the circumstances which ma) satist) the Commission:- (i) that appropriate discussions haH: taken place het\,ecn the employer and affected employees. (ii) that productivity and efliciency should be achieved in the enterprise or "orkplace as a result of the proposed variations and the reasons thcrefor. (iii) that there has been genuine agreement reached \\ith a majorit) of emplo) ecs. (i,) upon such other matters as ma) be appropriate in the particular circumstances. (e) each Industrial Organisation of Employees that is a party to the award being entitled to he heard when the application is made to the Industrial Commission for approval. (et) Any agreement as aforesaid reached het\\CCtl an emplo) er and employees shall be submitted lo tht: Commission for apprO\ al and shall ha\e no force or effect uniess and until apprO\cd hy the Industrial Commission. (5) The agreement as aforesaid. if approved shall operate as from the date detennined by the Commission \\hich may he the date agreed by the employ er and emplo:, ecs. prO\ ided that the employee, are not disadvantaged. (n) 'Housemaid-Waitress· shall mean an employee who is principally engaged upon Housemaid's duties as defined herein. and \\ho is also required to wait upon tables in a dining room. (o) ·Yardman-llandyman· shall mean an employee engaged in the maintenance. upkeep and cleansing of the buildings and/or environs of a motel including the outside of windows. and the sen icing of accommodation units including duties incidental thereto. (p) ·Laundress· shall mean an cmplO)CC: engaged m performing general laundry \\ork. (q) ·!lead Waiter· shall mean an employee appointed as such hy an employer and who is responsible for the supervision of the work of dining room staff (r) ·Restaurant ReceptionisUCashier· shall mean a female employee who is exclusively or principally engaged in attending the reception and/or cashier's desk in a motel restaurant: Provided that this definition shall not be deemed to include an employee whose principal duties arc the attending of any desk that is used for the reception of house guests. (s) ·Qualified Waiter· shall mean an employee who has completed a recognised apprenticeship or its equivalent as a qualified waiter. (t) ·Bar Attendant" shall mean an employee engaged in the dispensing and/or mixing of and/or sale of alcoholic beverages from a bar or other similar type of servery, (u) ·Restaurant Useful" shall mean an employee (other than a kitchen hand) assisting. as required. in the restaurant on non-waiting duties. (v) ·Baker· shall mean an employee who has completed a recognised apprenticeship or its equivalent and who produces breads and pastries for the kitchen. (ee) ·Room Attendant/Tray Carrier· shall mean an employee engaged in performing all general house-cleaning work and the preparation. delivery and collection of meal trays to and from units and the laundering of small items such as pillow slips. towels etc. (ff) ·Room Attendant/Waiter· shall mean an employee engaged in room attendant's duties and who may also be required to wait upon tables at breakfast in a dining room. (gg) • Laundry Worker· shall mean an employee engaged in general laundry work. (hh) ·Pantry Worker· shall mean an employee engaged in pantry duties, stock/inventory control as required by the motel. (iiJ •Linen Worker' shall mean an employee engaged in attending to linen stock and providing clean linen to guests rooms. (ij) • Messenger' shall mean an employee required to collect and/or deliver guests personal dry cleaning and laundry. linen and materials to and from accommodation areas. (kk) ·Parking Attendant' shall mean an employee employed in the parking of guests vehicles and other duties as required. (II) ·Leisure Activities Attendant" shall mean an employee who is responsible for setting up. distribution and care of leisure equipment. oversees leisure activities for guests. provides instruction on the safe use of equipment, assists guests in leisure activities. and other duties as required. (mm)'Yard Worker· shall mean an employee \\ho is engaged on the maintenance upkeep and cleansing of the buildings and/or environs of a motel including the outside of windows. and the servicing of accommodation units including duties incidental thereto, including the pool. (nn) ·utility Worker· shall mean an employee employed as such ,,ho maintains, washes. cleans and generally tidies motel guest areas ( excluding guest rooms). ( oo) 'llandy person· shall mean an employee not being a relevant tradesperson who maintains basic equipment and as required assists a Maintenance Officer in the case of other items of equipment. (pp) ·Motel Sales Representative· shall mean an employee engaged in marketing and publicity acti,ities on behalf of the property or properties.
