VARIATION
THIS matter co rning on for hearing before the Commission at
Bri~banc on 4 and 19 April 1995, this Co mm iss ion doth order that
the said Agreement be varied as follows as from the e ighth day of
May. 1995 :-
By deleting s ubclause ( I ) of clause 33 (Wages) and inserting the
following in lieu thereof:-
·'( I )Subj ect to claus es 3 2 and 3.3A hereof the minimum rates of
w ages to be paid to the und cnncntioncd classes o f employees shall
be as follows:-

Note I: The A ward Rate in cludes wage increases and
adjustments arising from State Wage Case decisions
colloquially referred to as: 2nd Tier Adjustment; I st (2
Parts) and 2nd Structural Efficiency Adjustmen1s, Ist,
2nd, 3rd & 4th Minimum Rates Adjustments and the 1st
and 2nd Safety Net Adjustmen ts. Arising from these
adjustments certain ' Excess Payments' have a lso been
identified and are payable to employees engaged in such
classifications as pa11 of their Agreement rate (see clause
3.3A - Translation to New Classifica ti on Structure).
These ' Excess Payments ' are not subj ect to absorption
of the Safety Net Adju stment. Such ' Excess Payments'
shall not have any su bsequent percentage based wa ge
increases appl ied to i t.
Note 2: The rates of pay in this Agreement include the first and
second $8.00 per week arbitrated Safety Net
Adjustments pa yable under the February an d December
1994 State Wage Case Decisions. Increases made under
previous State Wage Case Principles or under the
current Statement of Princ iples are not to be used to off-
set arbi trated Safety Net Adj ustments. The fi rst and
second $8 .00 per week arbitrated Safety Net Adju stment
may be off~set to the extent of any other wage increase,
whether an award increase. an overaward payment or an
increase by way of en terprise arrangement, received
since I February 1992. Pre Febrnary 1992, overaward
arrangements are to be applied according to their tenns.
Note 3: The percentage relativi.ties column relates to percentages
applying before the app licatio n of the two $8.00
arbitrated Safety Net Adjus 1men1s made in accordance
wi th lhe February 1994 State Wage Case and the
December 1994 State Wage Case. The percentage
relativities are based on a base rate and supplementary
payment tota ll i ng $417.20 per week. The percentage
relativities co lumn should also be app li ed by excluding
amounts payable to employees pursuant to c lause 3.3A
(Translation to New Classifica ti on Structure).".
