VARIATION
THIS matter com ing on for hearing before the Commission at
Brisbane on 5 January 1995, this Commission doth order that the
sa id Award be varied as follows as from the twen ty-third day of
January , 1995: -
By deleting subclause ( I) of clause 10 (Wages and A ll owances)
and inserting the following in lieu thereof:-

No te I: The Award Rate includes wage increases and
adjustments arising from State Wage Case decisions
colloquially referred to as: 2nd Tier Adjustment; I st (2
parts) and 2nd Structural Effic iency Adjustments; the
first, second and th ird Minimum R <1tes Adjustments and
$8.00 Safety Net Adjustment.

Note 2: The supp lementary payment at eac h classification level
includes an $8 . 00 adjustment reflecting the application
of the arb itrated safety net adjustment princ iple
enunciated in the February 1994 Review of Wage Fixing
Principles. Cons istent with the requ iremen ts of that
principle the $8.00 safely ne t adjustment is absorbable to
the ex tent of any equivalent amount in rates of pay -
whether overaward, award, industrial agreement or
ce rtified agreement - in excess of the minim um rates
(elassi fication rate and su pplementary payment)
prescribed in accordance with the October 1989 State
Wage Case dec ision and adjusted in accorda nce wi th the
July 1991 State Wage Case dec is ion.
'Overaward' Payment is de fi ned as the amount in
rates of pa y wh ich an emp loyee wou ld receive in
excess of the minimu m award wage as presc ribed in
this Award for the c lassification in which suc h
emp loyee is e nga ged which applied immediately
prior to the date of operation of this variation:
Provided that th is definition shall e xcl ude overti me,
shift a ll owa nces, penalty rates, ex pense related
allowances, industry allowances, d isabil ity
allowances, vacation allowances, special rates or
allowances, respons ibility allowances, o r any oth er
ancillary payments of a l ike natu re described by thi s
Award.
Note 3: The pe rcentage relativi ti es co lumn relates 10 percentages
applying before the app lication of the $8.00 arb it rated
safe ty net adjustment made in accordance wi th the
February 1994 Rev iew of Wage Fixing Principles:·.
