No. 152/2003 Land Act 1958 Land Act (Fees) Regulations 2003 The Governor in Council makes the following Regulations: Dated: 16 December 2003 Responsible Minister: MARY DELAHUNTY Minister for Planning SUDHA KASYNATHAN Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Land Act Regulations 1996 to increase certain fees payable in respect of Crown grants, leases, licences, permits, rights, consents or other instruments granted, issued or given under the Land Act 1958. 2. Authorising provision These Regulations are made under section 413 of the Land Act 1958. 3. Substitution of new Table in regulation 11 For the Table in regulation 11 of the Land Act Regulations 1996 1 substitute— "TABLE Column 1 Item Column 2 Description Column 3 Fee Payable Licence Fees— 001 (a) For entry under section 29 of an application for any licence granted under the Act $22 002 (b) for preparation and issue of any licence $41 003 (c) for consent to the transfer of any licence $41 004 (d) for preparation of any duplicate licence document $41 005 (e) for registration of a lien or of cancellation of the registration of a lien on a licence granted under the Act $41 Lease fees— 006 (a) for entry under section 29 of an application for any lease granted under the Act $22 007 (b) for preparation and issue of any lease, except for a residence area purchase lease $92 008 (c) for preparation and issue of any residence area purchase lease $9 009 (d) for consent to transfer, assign, mortgage, sublet or subdivide any lease $64 010 (e) for application by a licensee of auriferous land for a selection purchase lease $41 011 (f) for issue of a duplicate copy of an original lease searched by an officer of the Department at the Office of Titles if duplicate lease is lost $52 r. 4 -- 3 of 6 -- Victorian Legislation and Parliamentary Documents S.R. No. 152/2003 Land Act (Fees) Regulations 2003 3 Column 1 Item Column 2 Description Column 3 Fee Payable 012 (g) for instrument of discharge of a mortgage on a demise to which section 273 of the Act or any corresponding previous enactment applies $31 Crown grant fees— 013 (a) for preparation and issue of grant of Crown land sold in fee simple $92 014 (b) for declaration of Governor in Council under section 362A(1) of the Act $92 General fees— 015 (a) for consent of Minister under section 96 of the Act $52 (b) for preparation and supply of any deed or document not otherwise specified in these Regulations where the deed or document is prepared in connection with— 016 (i) an application under the Act; $92 017 (ii) a Crown grant, lease, licence, permit, right, consent, or other instrument granted or issued under the Act; $92 018 (iii) an endorsement, registration, discharge, transfer or assignment authorised by the Act $92 (c) for supply of documents concerning searches by an officer or officers of the Department made in connection with an application under the Act, a Crown grant, lease, licence, permit, right, consent or other instrument granted or issued under the Act or an endorsement, registration, discharge, transfer or assignment authorised under the Act, carried out at— r. 4 -- 4 of 6 -- Victorian Legislation and Parliamentary Documents S.R.
