n IESE MATIERS co ming on for hearing before the Commission at
3risbane on 7 and 9 ovember 1994, thi~ Co mmission doth order
hat the said Award be varied as follows as from the fourteenth day
1fNovembcr. 1994:-
1. By deleting subclause (I) or clause 3.3 (Salaries/Wages) and
in serting the following in lieu thcrcof:-
" 3.J alar ies/Wa,:es
( I )(a} ularies/Wages shall be paid weekl y or fort ni ght ly by
e lectronic funds transfer. Payment other than by this method should
be at the discretion of the cmplo)cr.
(b) Subjec t to clause 3.2 the salarie s/wages payable to the
undermentioned group) of employees engaged on or after 14
November 1994 shall be as prescribed in Schedule B(i) of this
Award. excep1 in the case of Den t is ts whose salaries arc prescri bed
in Schedule IJ (ii) of this Award:

Provided that those employees engaged prior to 14 November
] 994 who increased their ordinary hours of work in accordance with
Schedule G shall receive salaries/wages as prescribed in Schedules
B(iii) and B(iv)ofthis Award as from 14 November 1994."
2. By deleting subclause (13) of clause 4.2 (Implementation of
the 38 Hour Week) and inserting the following in lieu thereof:-
'"( 13) The provisions of this clause shall apply to those
employees who as at the date of operation of the Award were
working a 38 hour week as a result of prior applications to reduce
standard hours to 38 hours per week, to those employees who as a
result of the introduction of this Award had their hours of duty
reduced to 38 hours per week and to those employees (listed in
Schedule G) who have increased their standard hours to 38 hours per
week since the introduction of the Award.".
3. By deleting clause 5.4 (Conversion of Leave) and inserting
the following in lieu tr:ercof:-
"5.4 Conversion of Leave
( l) For the purposes of recreation leave, sick leave and long
service leave, all accumulated or accrued leave of employees shall
generally be credited on the basis of a 38 hour week and rates of pay
applicable to such leave shall consequently be credited on the basis
of a 38 hour divisor.
Consequently credits will be converted as follows:-
If in Weeks x 38 hours:
If in Days x 7.6 hours:
If in Hours x 38/y (where y = original ordinary hours per
week).
(2) Leave Debits - Leave debits will be equivalent to the
ordinary hours employees would have worked had they not been on
paid leave. Such leave will therefore be paid and debited on the
basis of hours actually taken:
Provided that those categories of employees listed in Schedule F
of this Award shall have the calculations based on the hour divisor
specified in that schedule.".
4. By deleting Schedule B(i) and inserting the follm,ing in lieu
thereof:-

The rates of pay in this Award include the first $8 per week
arbitrated safety net adjustment payable under the November 1994
State Wage Case decision. Increases made under previous State
Wage Case principles or under the current Statement of Principles
arc not to be used to offset arbitrated safety new adjustments. This
first $8 per week arbitrated safety net adjustment may be offset to
the extent of any other wage increase, whether an award increase, an
overaward payment or an increase by way of enterprise arrangement,
received since I February I 992. Pre February 1992 overaward
arrangements are to be applied according to their terms.".
5. By deleting the paypoints and fortnightly rates from under
the heading "Dental Officers" in Schedule B(ii) and inserting the
following in lieu thereof:-

The following conversion of pay scales shall apply to those
Dental Officers engaged prior to 14 November 1994 lis1ed m
Schedule G whose hours have increased to 38 hours per week.
The fortnightly rates are the actual salaries/wages paid and
annual rates shown for information purposes only.

The rates of pay in this A ward include the first $8 per week
arbitrated safety net adjustment payable under the November 1994
State Wage Case decision. Increases made under previous State
Wage Case principles or under the current Statement of Principles
are not to be used to offset arbitrated safety new adjustments. This
first $8 per week arbitrated safety net adjustment may be offset to
the extent of any other wage increase, whether an award increase, an
overaward payment or an increase by way of enterprise arrangement,
received since I February 1992. Pre February 1992 overaward
arrangements are to be applied according to their terms.
Provided that:-
(a) Staff Dentists Division II shall commence on paypoint I and
shall be eligible to advance by annual increments to
paypoint 6 and no further.
(b) Staff Dentists Division I shall commence on paypoint 6 and
advance no further.
(c) Dental Officers Division III shall commence on paypoint 4
and shall be eligible to advance by annual increments to
paypoint 8 and no further.
(d) Dentists in Charge Division V shall commence on paypoint
3 and be eligible to advance by annual increments to
paypoint 8 and no further.
(e) Dentists in Charge Division IV shall commence on paypoint
4 and shall be eligible to advance by annual increments to
paypoint 8 and no further.
(f) Dentists in Charge Division Ill shall commence on paypoint
8 and shall be eligible to advance by annual increments to
paypoint 9 and no further.".
8. By deleting Schedule F (Categories of Employees Working
Other Than Thirty-Eight Hours Per Week) and inserting the
following in lieu thereof:-

CATEGORIES OF EMPLOYEES WORKING OTHER
THAN THIRTY-EIGHT HOURS PER WEEK
Classification Ordinary Hours
Employees of Pathology Departments
and other hospital laboratories where
the hours of duty of Scientists, Technicians,
Scientific Assistants and Cadets were
determined at 36.25 per week under the
Professional and Technical Employees'
Award- Public Hospitals, Queensland

9. By inserting a new Schedule G (Categories of Employees
Whose Hours Have Increased to Thirty-Eight Hours Per Week) as
follows:-
