THIS matter coming on for hearing before the Commission at
Brisbane on 18 October 1994, this Commission doth order that the
said Award be va ri ed as follows as from the twenty-fourth day o f
October, 1994:-
I. By deleting clause 3B (Wages) and inserting the following
in lieu thereo f: -

Note I: The A ward Rate includes wage increases and
adjustments arising from State Wage Case decisions
colloquially referred to as 2nd Tier Adjustment; I st (2
pans) and 2nd Structural Efficiency Adjustments; four
Minimum Rates Adjustments and the Safety Net
Adjustment.
Note 2: The supplementary payment at each classification level
includes an $8.00 adjustment reflecting the application
of the arbitrated Safety Net Adjustment Principle
enunciated in the February, 1994, Review of Wage
Fixing Principles. Co11sistent with the requirements of
that principle the $8.00 Safety Net Adjustment is
absorbable to the extent of any equ ivalent amount in
rates of pay - whether overaward, award, industrial
agreement or certified agreement - in excess of the
minimum rates (classification rate and supplementary
payment) prescribed in accordance with the October
1989 State Wage Case decision and adjusted in
accordance with the July 199 I State Wage Case
decision.
Over-award Payme n1 - Over-award payment is
defined as the amount in rates of pay which an
empl oyee would receive in excess of the minimum
award wage as prescribed in this Award for the
classification in wh ich such employee is engaged
which applied immediately prior to the date of
operation of this variation:
Provided that this defin it ion shall exclude overtime,
shift allowances, penalty rates, expense related
allowances. industry allowances, d isability
allowances, vacation allowances, special rates or
allowances, responsibility allowances, or any other
anci ll ary payments of a like nature described by this
Award.
Note 3 : The percentage relativities column relates to percentages
applying before the ap plication of the $8.00 arbitrated
Safety Net Adjustment made in accordance w.ith the
February. 1994, Review of Wage Fixing Principles.".
2. By deleting subclause (3) of clause 20 (Extra Rates).
3. By deleting subclause ( 11) of clause 35 (Extra Rates)
