Note 2: The supplementary payment at each classification level includes an $8 .00 adjustment reflecting the appl ication of the arbitrated safety net adjustment principle enunciated in the February 1994 Rev iew of Wage Fixing Principles. Consistent wi th the requiremen ts of that principle the $8 .00 safety net adj ustment is absorbablc to the extent of any equivalent amount in rates of pay -· whether overaward. award, industrial agreement or certified agreement - in excess of the minimum rates (classification rate and su pp lementary payment ) prescribed in accordance with the October 1989 No te 3: State Wage Case decision and adjusted in accordance with the July 1991 State Wage Case decision. 'Overaward' Payment is defined as the amount in rates of pay which an employee wou ld receive in excess of t he min imum award wage as prescribed in this Award fo r the classifica ti on in which such employee is engaged which app li ed immediately prior to the date of operation of this variation: Pro vided that this definition shall exclude overtime, shi fl allowances, pena lt y rates. expense related allowances. industry allowances, disab il ity allowa nces, va cation allowances, special rates or allowances. responsibility allowances, or any other ancillary payments of a like nature desc ri bed by th is Award. The percentage relativities col umn relates to percentages applying befo re the application or the $8.00 arbitrated safety net adjustment made in accordance with the February 1994 Rev i ew of Wage Fixing Principles.''.
