No. 125/2003 Motor Car Traders Act 1986 Motor Car Traders (Amendment) Regulations 2003 The Governor in Council makes the following Regulations: Dated: 28 October 2003 Responsible Minister: JOHN LENDERS Minister for Consumer Affairs SUDHA KASYNATHAN Acting Clerk of the Executive Council 1. Objectives The objectives of these Regulations are to amend the Motor Car Traders Regulations 1998 to— (a) prescribe further particulars for the purposes of sections 8 and 20 of the Motor Car Traders Act 1986; and (b) prescribe new offences for which a penalty notice can be issued; and (c) revoke regulations prescribing forms which are no longer required. 2. Authorising provision These Regulations are made under section 90 of the Motor Car Traders Act 1986. 3. Commencement These Regulations come into operation on 1 November 2003. -- 2 of 5 -- Victorian Legislation and Parliamentary Documents S.R. No. 125/2003 Motor Car Traders (Amendment) Regulations 2003 2 4. Principal Regulations In these Regulations, the Motor Car Traders Regulations 19981 are called the Principal Regulations. 5. New regulation 7 substituted For regulation 7 of the Principal Regulations substitute— "7. Particulars for application for licence For the purposes of section 8(5)(g) of the Act, the prescribed matters are— (a) the telephone numbers of any premises from which a motor car trading business is to be conducted; and (b) if the applicant is a corporation, the date of appointment of each director; and (c) if the applicant is a partnership, the date each member of the partnership became a partner.". 6. Form of licence Regulation 8 and Form 4 of the Principal Regulations are revoked. 7. New regulation 14 substituted For regulation 14 of the Principal Regulations substitute— "14. Claims against Fund The form required by these Regulations for the purposes of section 76(3) is Form 9.". 8. Form of Registrar's certificate Regulation 15 and Form 10 of the Principal Regulations are revoked. r. 4 -- 3 of 5 -- Victorian Legislation and Parliamentary Documents S.R. No. 125/2003 Motor Car Traders (Amendment) Regulations 2003 3 9. Form and particulars in the register of the Authority Regulation 16 and Form 11 of the Principal Regulations are revoked. 10. Prescribed changes in relation to licensee For regulation 20(b) of the Principal Regulations substitute— "(b) a licensee commences carrying on business as a motor car trader under a name or names in addition to or in substitution for the name of the licensee; (c) a licensee changes the business address or telephone number of any premises from which a motor car trading business is conducted; (d) a licensee changes the address of any Internet site maintained by the licensee for the purpose of the motor car trading business.". 11. Secrecy Regulation 31 of the Principal Regulations is revoked. 12. Infringement notices In the Table in regulation 32(2) of the Principal Regulations, after "section 52(6) 1" insert— "section 83A(1) 5 section 83A(3) 5" 13.
