. THIS matter coming on for hearing befo re the Comm iss ion at
Bnsb ane on 12 April 199 4, this Commission doth order that the
said Award be varied as fol lo ws as from the eighteenth day of
Apr i l, 1994 :-
By dele ti ng subclause {l ) oi clause 3 (Wages and
Allowances) and i nsening the fol l owing 111 lieu thereof:-
"Wages and Allowances
3 .11 l Subject to cl ause 2A hereol, the minimum rates of
wages to be paid to the undermentioned cl asses of employees

Calcula tion o f Junior Rates - The r ates of pay applying to
j uni or emp loy ees shall be calculated in multi ples of ten cents
with any result of five ce n ts or more being ad j usted to the next
highest ten cent mult i ple.

The Award Rate incl udes wage in creases and
adjustments arising from St ate Wage Case
decisions co lloquially referred to as: 2nd Tier
Adjustmen t; 1s t (2 parts) an d 2nd Structural
Effic ien cy Adju st ments; and $8.00 Safety Net
Adju st ment.
The Supplementary payment at each cl assi fication
level reflec ts the $8.00 arbitrated safety net
adjustment princ ip le en unciated in the February
1994 Review of Wage Fixing Pri nciples.
Consistent with the requiremen ts of that pri ncip le
the safe ty net adjustment is absorbable to the
extent of any equivalent amoun t in rat es of pay -
whe ther overaward, award, industri al agreement or
certified agreement - in excess of the minimum
r ates (classification rate and supplementary
paymen t) prescribed in accordance with the
October 1989 Sta te Wage Case decision and
adjusted in accordance w i th the Jul y 1991 State
Wage Case decision.
'Overawa rd' Payment is defined as the
amount in rates of pa y wh ich an employee
would receive in ex cess of the minimum
award wage as prescribed in th is Award for
the classification in which such employee is
engaged which applied im mediately prior to
the date of operation of this variation:
Prov ided that this defini tion shall exclude
overti me, shift al lowan ces, pen al ty r ates,
expense re lated al lowances, i ndust ry
allowance s, disability allowances, vacat ion
al lowances, special rates or allowances,
respons ibi lity allowances, or any other
anc ill ary paymen ts of a like na tu re described
by th is Award.".
