Consistent with the requirements of that princ ipl e the .$8 .00 Safety Net Adjustment is absorbab le to the extent of any equivalent amount in rates of pay - whether overaward, award, industrial agreement or certi fied agreement - in excess of the minimum rates (base rate and supplementary payment) prescribed in accordance with the October 1989 State Wage Case decis ion and adjusted in accordance with the July 199 1 State Wage Case decision. In this instance, the absorption principle has been applied to the overaward payment which includes, among other amounts, pre-existing service increments and experience payments. 'Overaward' Payment is defined as the amount in rates of pay which au employee wou ld receive in excess of the minimum award wage as prescribed in this Agreement for the classifi ca tion in which such emp loyee is engaged which applied immediately prior lo the date of operation of thi s variation: Provided that this definition shall exclude overt ime , shift allowances, pena lty rates, expense re lated allowances. industry allowances, disability allowances, vacation allowances, special rates or allowances. responsibility allowances, or any other ancillary payments of a like nature described by this Agreement. Note 3 The percentage relativities column relates to percentages applying before the appl ication of the $ 1.05 divisional al lo wance and the $8.00 arbitrated safety net adjustment made in accordance wi th the February 1994 Re view of Wage Fixing Principles. The percentage relativities are based on a base rate and supplementary payment totalling $4 17.20 per week.
