. TH IS matter coming on for hearing before the Commission at
Brisbane on 25 March 1994, this Commission doth order tha t the
said Awa rd be varied as follows as from the twenty-eighth day of
March, 1994:-
By deleting su bclause ( 1) of cla use 6 (Wages) and inserting
the fol low ing in lieu thereof:-

NOTE The total wage rate of pay is inclusive of the base
wage rate and the $8 SNA and also incl udes increases in
accordance with the SEP October 1989 - 1st Payment wage
inc rease .

rep~esents an $8 .00 adjustment reflec ti ng the appl ication of the
arbi tra ted safety ne t adjustment pr inc ip le enunciated in the
February 1994 Review of Wage Fixing Pr inciples. Cons is tent with
the requ irements of that pri nc iple the $8 .00 safety net adjustment
Is absorbable to t he ex te nt of any equivalent amount in rates of
pay. _- whether overaward, award, industri al agreement or
certified agreement - in excess of the minimum rates

accordance with the October 1989 State Wage Case decision and
adjusted in accordance with the July 1991 State VVage Case
decision.
NOTE: 'Overaward Paymen t' is defined as the amount
(whe.t her it be termed 'overaward payment', 'attendance bonus',
service increment' or any term whatsoever) wh ich an employee
would received i_n excess of the 'Award Wage· for the
classif1cat ,on ,n wh,ch the employee is engaged:
Provided that such payment shall exclude overtime shift
al lowances, penalty rates, allowances, fares and travell ing time
allowances and any other ancillary payment of a like nature
prescribed by th is Award.
