T HIS matter comi ng on for hearing before the Commiss ion at
Brisbane on 24 March 199 4, this Commission doth order that the
said Award be varied as fo ll ows as from the twenty-fou rth day of
March, 1994 :-
1. In clause 2 .1 (Wages) of Appendix A:-
(a) by delet in g su bclause ( I) o f item A "On-Si te Building
Construction" and inserti ng the following in lieu thereof:-
"2.1 Wages
/\. On-Site Bui ld ing Construction
(l) Except as provided fo r in section B hereof the minimum rate
of wages payable to the following c lasses o f employe~s engaged on
what is te n ned 'on- si te work' - i.e. bu ilding construc ti on wo rk shall

classification in which such employee is engage-d which applJed
immediately p ri or to the date of opera ti on of this variation:
Provided that this de finition sh all excl ude ov ertime. shi ft
allowances. pe nalty rat es, expense re lated all owances, mdus try
allowances, disability a ll owances, vacation allowances, special
rates or allowances, r es ponsibi li ty allowances, _or any other
ancillary payments or a like nature descri bed by this Award .

adjus ted in accord ance with the Ju ly 199 l State Wage Case
decision.

award wage as prescribed in this Award fo r the classification in
which suc h e mployee is en gaged which ap plied immediately
prior to the da te o f operation o f this varia ti on:
Prov ided that this de fin ition sha ll exc lude overtime, shift
allowances, pena lt y rates, ex pense related allowances , industry
allowances. d is ab ility allowances, vacation allowances. specia l
rates or all owances. respons ibi li ty a ll owances, or any other
anci llary pay ments of a like nature described by this Award.".
2. By deleting Schedu le 2 to the A ward and inse11ing the

The wage rates li sted include a minimum rate adj ustment which
shall be ab sorbed into overaward payments where s uch payments
are be in g made.
• The interim supplementary payment at each c lassi Ii cation
leve l re fl ec ts the $8 .00 arbitrated safety net adjustment principle
enunciated in the February 1994 Revi ew of Wage Fixing Principles.
Consistent with the require ments of th at principle the safety net
adjus tment is ab sorbablc to the extent of an y equ ivalent amount in
rat es of pay - whether overaward, award , industrial agree me nt or
certified agreement in excess of the minimum rates
(base/classification rate and supplementary pay ment) prescribed in
accordance with the October 1989 State Wage Case decision and
adj usted in accordance with the July I 99 I State Wa ge Ca se
dec ision.
'Overaward Payment' is defined as the amount (wheth er it be
termed 'overaward payment', 'atten da nce bonus', 'service
in crements', or any tenn whatsoever) wh ich an employee would
receive in excess of the 'Award Wage' which applied
immediately p ri or to the da te of operation o f any broadband ing
or minimum rates adjustment awarded by the Commission for
the classification in wh ich the employee is engaged :
Provided that such payment shall not include overtime, shi ft
allowances, penalty rates, allowances, fa res and travelling time
all owances and any oth er ancillary payment of a like nature
prescri bed by this Award.".
