DECIS ION On 28 Feb ruary 1994, the Fu ll Bench granted an appli cat ion m ade under s. 44 of the Industrial Relations Act 1990 by the Austra lian Council of Trade Un io ns Quee ns land Branch (ACTUQ) on behalf of a number of its affiliates in relation to Gladstone Power Sta tion. At the time of the hearing, the Commission was adv i sed that the sale of the Gladstone Power Sta tion was due to be com pleted on 1 April 1994. This then became the operat i ve date for the s. 44 Order. T he Comm is sion has now been advi sed in wri ting t hat this date is to be brought forward to 30 th March 1994. Accordingly, the parti es have requested th e operati ve da te for t he s. 44 Order harmoni ze with the handover date. We have gi ven consi deration to this reques t. In our view it does not alt er the substance of our decision and fu rth er, we believe it wo uld be appropri ate for the ha ndover da te an d the operative date for the s. 44 Order to coi ncide.
