TH IS matter coming on for hearing befo re the Commi ss ion at
Brisbane on 23 March 1994, this Commission doth order that the
said Aw ard be vari ed as fol lows as from the twenty-eig hth day of
Ma rch, 1994:-
By deleting subcl ause (1) oi cl ause 5 (Wages) and inserting
the following i n lieu thereof:-
"Wag es
5.( 1) Adu/ls - Th e m inimum rates of wages payable to
adult employees shall be as follows :-
The new classi fi ca tion structure expresses the interim total
rate pa yable, be ing the combination of 1he base r ate, the fi rst and
seco nd mi ni mu m ra tes adj uslments and th e $8.00 safe ty net
adjustm en t. Such minimum rates adjustment is 10 be ab sorbed
i nto overaward paymen ts where such paym en ts are be ing made.
'Ov eraward Payment' is defined as the amount (whether it
be termed 'overaward payment', 'attendance bonus',
•se rvice increment' or any term whatsoever) which applied
i mmediately prior to the date of operation of this variation:
Provided that such payments shall excl ude overtime, shih
allowances, penalty rates, allowances fares and travell ing time
allowances and any other ancillary payment of a like nature
prescribed by this Award.

Note: The to t al interim wage rate includes the following
wage incr eases: Second Tier March 1987: the SEP October 1989
- 1st and 2nd Paym ents; SEA Ju ly 199 1; and 1994 $8 SNA.
Note: The supplementary payment at each classification
level includes an S8.00 adjustment reflecting the appli ca ti on of
the arbitrated safety net ad j us1ment principle enunciated in the
February 1994, Review oi Wage Fi xing Pr inci ples. Consistent
with the requirements of that principle the $8.00 safety net
adjustme~t i s ab sorbable to the extent of any equivalent amouni
in rates ot pay - whe ther overaward, award, industrial ag reement
or certified agreement - in excess of the minimum r ates
(classification rate and supplementary paymen t) prescribed in
accordan ce with the October 1989, State Wage Case d ec ision and
adjust ed in accordance w ith the July 1991, State Wage Case
decision.
