Brisb ane on 18 March 1994, this Commi ss ion doth order that the
said A ward be vari ed as fo llows as from the twenty-eighth day of
March, 19 94 :-
By deleting subclau se ( 1) of clause 3.3 (Wages) and i nserting
the follow ing in li eu th ereof:-

(1) Th e min i mu m rat es payable under this Award shall be
as fol lows:
The new classification structure exp resses the award ra te
payabl e, being the comb ination of the minimum classification
rate, the supplementary payment which includes th e $8 safety net
ad j ustment and the broadbanding and mini mu m ra tes
ad justments. The award rate inclu des all inc rease s and
ad justments arising as a result of the Second Tier, 1st and 2nd
struct ural efficiency payment an d structural efficiency ad ju st m en t
and 1st, 2nd an d 3rd min imum rat es adjustments.

• The supplementary paymen t at each classification i ncludes
an $8.00 adjustment reflecti ng the application of the arbitrated
safety net adiustmen t prin cip le enunciated in the February 1994
Rev iew of Wage Fixing Principles. Consisten t w i th the
requirements of that Principle the $8.00 sa fety net ad j ustment is
absorbable to the extent of any equivalent amou nt in rates of pay
- w hether overaward. award, ind us1r i al agreement or certified
agreement - in excess of the minimum ra te s (cl assi ficat ion rate
and supplementary payment) prescribed i n accordance w ith the
October 1989 State Wage Case decision and adjusted in
accordance w ith the July 1991 State Wage Case decision.
'Overaward' Payment 'Overaward' payment i s
defined as the amount in rates of pay wh ich an employee would
receive in excess oi the minimum award wage as prescribed in
this Award ior the classi i ication in which such employee is
engaged wh ich applied immediately prior to the date of operation
of this va riation:
Provided that this definition shal l exclude overtim e, shi ft
al lowances, penalty ra tes , expense related al lowances, industry
allowances, disabili ty allowances, va cation allowanc es, spec i al
r ates or al lowances, responsibility allowances, or any other
ancillary paymen ts of a like nature described by this Awa rd.· .
