The n ew class ification st ructure expresses the awa rd rate payabl e, being the combinati on of the pe rcentage base rate, a supp lementary payment wh ich includes the $8 safety net ad j ustm ent. The award rat e includes all increases and adjustments arising as a resul t of t he Second Tier. 1st and 2nd structural effici en cy payment and st ru ctural effic iency ad j ustment and 1st, 2nd, 3rd and 4th mi nimu m rates ad j us tm ents. Consi sten t w i th the requirements of t hat Pr in ciple the $8.00 safety net adjustment i s absorbab le to t he exten t of any equi va lent amount in rates of pay - whether over awa rd, awa rd , industri al agree m en t or certified agreement - in excess of the m ini mum rates (class ification rate and supplementary payment) prescribed in accordance with the October 1989 State Wage Case decision and ad ju sted in accordance with t he Ju ly 1991 State Wage Case decision. Overaward Paym ent - Overaward payment i s defined as the amount in r ates of pay which an empl oyee wou ld receive in excess of the minimum awa rd wage as prescribed in this Award for t he class ification in which such empl oyee is engaged which applied immediately pri or to t he d ate of operati on of this v ar ia tion: Provided that this defini tion sha ll excl ude overtime, sh ift a llowanc es, penalty ra tes, expense r ela ted allowance s, industry allowa nces, di sab i li ty allowances, vaca tion allowances, special rate_s or a llo wance s, res ponsibility allowances, or any other ancillary payments of a like nature described by th is Aw ard.
