THIS matter coming on for hearing before the Commission at
Bri sbane on 14 March 1994, this Commission doth order that the
sa id Award be vari ed as follows as from the twenty-first day of
March, 1994 :-
By deleting subclau se s (1 ) and (3)(i) of clause 7 (\,Vages) and
inserti ng the followi ng in li eu thereof:-

Note 2 The supplementary payment at each cl ass ification
incl u des an $8.00 adjustment reflecti ng the application of the
arbitrated sa fety net adjustment pr i ncip le enunciated in the
February 1994 Review of Wage Fixing Pri nciples. Con sis tent
w ith the requ irements of that Pr inc iple the $8.00 safety net
adjustmen t i s absorbable to the exte nt of any equival en t
amount in rates of pay - whether overaward, award,
industri al agreement or certified agreemen t - in excess of
the minimum rates (classification rate and supplementary
payment) prescribed in accordance w ith the October I 989
State Wage Case decision and adjust ed in accordance wit h
the Jul y I 991 State Wage Case decision.
'Ov eraward' Payment is defined as the amount
in rates of pay which an employee wou ld receive
in excess of the minimum award wage as
prescribed in thi s Award for the class ification m
which suc h emp loyee is engaged wh ich appli ed
immediately pri or to the da te of operation ot th is
variation:
Provided that this definition sh al l exclude
overt im e, sh i ft allowances, penalty rates, expense
related allowances, industry allowances, disab il ity
allowances, vacation allowances, special r ates or
allowances, responsibility allowances, or any other
ancillary payments of a li ke nature described by
this Award .'.
