Ar ising from these adjustments certain Excess Payments' have al so been i dentifi ed and are payable to employees en g aged i n such cl assi fications as part of their Awa rd Rate (See subcl ause ( 2) ' Excess Payments' of cla u se 3.3 (Wages)). These 'Excess Pay ments' are not subject to absorption of the Safety Net Adjustment. Such Excess Pay ment ' shall not have any subsequent percentage b ased wage increase applied to it. Note 2 - The supplementary payment at each classification incl u des an $8.00 adjustmen t reflecti ng the appl ication of the arbitrated safe ty net adjustmen t principle en unciated i n the February 1994 Review of Wage Fi xing Pr i nc iples. Consistent w ith the requi rements of that Pri nci ple the $8.00 safety net adjustment is abso rbable to the extent of any equivalent amoun t in rates of pay - whether overaward, award, industria l ag reement or certified agreement - in excess of the mi nimum rates (class ification rate and supplementary paymen t) prescribed i n accordance with the O ctober 1989 State Wage Case decision and ad ju sted in accordance w ith the July 1991 State Wage Case decision. 'Overaward' Payment is defined as the amount in rates of pay wh ich an employee would rec ei ve in excess of the minimum award wage as pr esc rib ed in this Award for the class ification in w hich such employee is engaged wh ich appli ed im mediately pr i or to the date of operation of th is variation: Provided tha t this definition sha l l exclude overtime, shi ft al lowances, penalty rates. expense related allowances, industry allowances, disability allowances, vacation allowances, special rates or al lowances, responsibi lity allowances, or any other anci l lary payments of a like na ture described by this Award.' .
