. TH IS matler com ing on for hearing before the Commission at
Brisban e on 14 Marc h 1994, this Commi ssion doth order that the
said Award be vari ed as fol lows as from the fourteenth day of
Ma rch, 1994:-
By deleting subcl ause (1) of clause 3.4 (Wage s) an d i nserting
the fol low ing in lieu thereof:-
' 3. 4 Wages
(1) Subject to clause 3 .3 hereo f, the rn, n,mum w ee kly w age
to be pa id to emplo yees in the Eastern D istrict of the So uthe rn
D ivision shall be as fol low s:-
The n ew classifi ca tion structure ex presses the award rate
payabl e, be ing the co mbina ti on oi the perc en tage base rate and a
supplemen tary payment whic h includes th e $8 safety net
adjustmen t.

Excess Payments - Emp loyees employed in the
class if ication of Op tic al Employee Grade I sha ll receive an excess
payment of $4.60 per week. Such amou nt i s nol to be adjusted.
• The supplementary payme nt at each classi fication i nc lud es
an $8.00 adju st ment reflecting the application of the arbitrated
safety net adjustment principle enunciated in the February 1994
Revi ew of Wage Fixing Pri ncip l es . Consistent w ith the
requ iremen ts of that Princ ip le the $8.00 safety neI adjustment is
absorbable to the extent of any eq uivalent amount in r ates of pay
- w hether overaward, award, industrial agreement or certifi ed
agreement - in excess of the mini mum rates (cla ssi fication rate
and supplementary paymen t) prescribed in accordance with the
O c to ber 19 89 State Wage Case decisi on and adjusted in
accordance w ith the July 1991 Sta te Wage Case decision.
' Overaward' - ' Overaward ' payment is de fi ned as
the amount in rates of pay which an employee wo uld
receive in excess of the min im um award wage as
presc ribed in th is Award for the cl ass ification in wh ich
such employee i s eng aged wh ic h applied im mediately
pnor to the date of opera ti on of th is variation:
Provided that th is definition sha l l excl ude overti me, sh ift
allowances, penalty r ates, expen se related al lowances,
industry al low ances, di sab i lity al lo wa nces, va ca tion
al lowances, special r ates or al lo wances, resp ons ib i lity
al lowan ces, or any other an cil lary payments of a like
nature described by this Awa rd.
The pe rcen tage relativi Ii es relate to percen tages app lyin g
before the appl icati on of the $8.00 arbiI ra ted sa fety net
ad ju stment made in accordance wit h the February 1994 Review
of Wage Fi xing Princ ipl es .
