The award rate includes al l increases and adjustments arising as a result of the Seco nd Tier, 1st and 2nd structural efficiency payment and Structural Effic iency Adjustmen t. Consisten t with the req uiremen ts of that Principle the $8.00 safety net ad ju stment is absorbabl e to the ex te nt of any equivalen t amount in r ates of pay - w hether overaward, award, industri al agreement or certified ag reement - in excess of the min im um rates (classification ra te and supplementary payment) prescribed in accordance w i th the October 1989 State Wage Case decision and ad justed in accordance with the July 199 1 State Wage Case decision. ·overaward' Payment is defi ned as th.e amount in rates of pay whi ch an employee would receive in excess of the min imum award wage as prescribed in this Agreemen t for the classification i n wh ich such employee i s engaged wh ich applied immediately prior to the date of operation of this variation: Provid ed that this defini tion sha l l exclude overtime, shift al lowances, pen al ty ra tes, expense related allowances, i ndustry allowances, disability allowances, vacation all ow an ces, sp ec ial rates or all owances, responsi bil it y al low an ces, or any other ancillary paymen ts of a like nature descri bed by this Agreemen t.'.
