Brisbane on 14 March 1994, this Commission doth order tha t the
sa id Awa rd be varied as follows as from the twenty-first day of
March, 1994:-

Note 1 - The award r ate includes wage increases and
adjustmen ts arising from State Wage Case decisi ons
col loqui al ly referred to as: 2nd T ie r Adjustment; 1st (2 parts)
and 2nd Structural Efficiency Adjustments; 1st , 2nd, 3rd a nd
4th M inimum Rates Adj ustments and $8 Safety Net
Adjustment.
Note 2 - The supplementary paym en t at each
classificati on incl udes an $8.00 ad justment reflecting the
application of the arbitrated safety net adjustment principle
enunciated in t he Feb r ua ry 1994 Rev iew of Wage Fixing
Pr inciples. Consistent with the requirements of that Principle
t he $8.00 sa fe ty net adjustment is absorbable to the extent of
any equivalen t amount in rates of pay - whether overaward,
award, industrial agreement or certified ag re ement - in
excess of the mi nimum rates (class ification rate and
supplemen tary payment) prescribed in accordance with the
October 1989 Sta te Wage Case decision and adjusted in
accordance with the July 1991 State Wage Case deci si on .
'Overaward' payment is defined as the amount in
rates of pay wh ich an employ ee would recei ve in
excess of the minimum award wage as prescribed in
this Award for the class i ficat io n in which such
employee is engaged which appli ed immediately pri or
to t he date of operation of this variation:
Provided that this definit io n sha ll exclude overtime, shift
allowances, penalty rates, expense related allowances,
industry allowances, disability al low ances, vacation
allowances, spec i al rates or allowances, responsibility
allowances, or any other ancillary payments of a like
nature described by Ihis Awa rd.
Note 3 - T he percentage re lativiti es column relates to
percentages applying before the application of the $8.00
arbitrated Safety Net Adjustment made in accordance with
the February 1994 Review of Wage Fixing Principles.' .
