TH IS matter com ing on for hearing before 1he Commission at
Brisbane on 4 and 11 March 1994, thi s Commiss ion doth order
that the said Awa rd be varied as follows as from the fifth day of
Ap ri l, 1994:-
By del et ing subclause ( 1) oi clause 3 .3 (Wages) and inserting
the foll ow ing in lieu thereof:-
" (] } Adults - T he minimum ra tes oi wages payable to adult
empl oyees sha ll be as foll ows:-
The new cl ass ificat ion structure expresses the total award rate
payabl e, being 1he comb ination of the percen tage base ra te and
the supplementary paym ent wh ich inclu des the $8 safe ty net
adiustment. Suc h supplementary payment i s absorbable to th e
exten t. of equi va lent overaward payments where such payments
a re being m ade. The total award rate inclu des all increases and
ad)ustm ents arising as a res u lt of t he second ti er, structural
effic_,ency payments, structural efficiency ad j ustmen ts and
m1 n1mum rates process.
The percentage relativiti es are based on a base rate and
suppl ementary payment totall ing $4 17.20 per week.
'Overaward Payment' is defined as the amoun t (whether it be
termed 'overaward payment', 'attendance bonus ', 'service

inc rement' or any te rm whatsoever) wh ich applied imm ed iately
pri or to the da te of operat ion of any m inimum rates ad justment
awarded by t he Commi ss ion for the cl assification in wh ich 1he
employee is engaged:
Provided tha1 such payment shal l ex cl u de overtime, sh ih
al lowances, penalty rates, allowan ces fares and travel ling time
al lowances and any 01her anci llary payment of a li ke nature
prescribed by this Award.

The supplementary payment at each class ification level
includes an $8 .00 ad j us tment re fl ec ting the app lication of the
arbitrated safe ty net ad justment principle enunciated in the
February 1994 Rev i ew of Wage Fi xing Principles. Consistent with
t he requirements of that Pr i ncipl e 1he $8.00 sa f ety net adjustment
i s absorbable to the extent of any equival en t am ou nt in rates oi
pay - whe1her overaward, awa rd. industrial agreement or
cert ifi ed ag reement - in excess of the minimum rates
(classification rate and supplementary payment) prescribed in
accordan ce with the October 1989 Sta te Wage Case decision and
ad j ust ed in accordan ce with th e Ju ly 199 1 State Wage Case
decision.
The tota l interim wage ra te includes the fo ll owi ng wage
increases: 1987 REP; the first and second 1989 SEP i nc reases;
1991 SEA and all minimum ra tes adjustments.".
