Industrial Agreement Ca tering Se rvi ces Staff (Reta il Stores) Award - South• Eastern Division This interim Award appli es 10 empl oyees formerly covered by the Clerks and Switchboard Atten da n ts in Re ta il Stores Award - State (rescinded as irom 24 August 1993). (2) Th is Award sha ll apply to all emp loyees engaged in t he reception and/or preparat ion and/or h ire and/or sa le and/or delivery (excepting any employees en gaged solely in the delivery o( newspapers) and/or installation oi any goods and/or services by retail, and applies to persons emp loyed wholly or principa lly as ,1 cl erk as defined herein. (3) This Awa rd also appli es to employees covered by: {al the Garage and Se rvice Station Attendants ' Award State (f xc luding South-Ea~tern Di strict); the Motori ng Servi ces Award - So uth-East ern D istrict; Industrial Contract and foo d Serv ices Aw ard where such employees are employed in a retail establishment such as a departn1en t store, discount department store or supermarket, and (b) t he Miscellane ous Workers' Award - State, where such employees are employed in a reta il establi shme nt. (4) Th is Award wi th the exception of clauses 3.5, 5.1, 5.2, 5.3 and 5.4 wit h the exception of employees engaged in the demons trat ion and/o r sa le an d/or hire and/or ren tal of te levision rece ivers and/or parts in th e hom es of prospective cl ients shall not apply to employees (excluding cl erks) in receipt of a week ly wage wh ich is equal or grea ter than 12 5 per cen t of the ra te prescribed in the Awa rd for Shop Ass ist an t s. Th i s amount sha ll be excl u si ve oi bonuses or comm is sions. (5) This Award appl ies to pe rs ons employed wholly or principally as a clerk as defined herein within the State oi Q uee nsland; but excluding: (a) A clerk as defined herein, and who is remunerated at a level in excess of the highest award rate prescrib ed herein in the South ern Div ision, Eastern D is trict, shall be exempt from the provision s of thi s award except for those prescribed by clause 5 .1 (Annual Leave); cl ause 5.3 (Sick Leave ); clause 5.4 (Long Service l eave ); clau se 3.5 (Occupational Supe ran nuation); clause 2.5 (Preference); clause 5.5 (Pa ren tal lea v e) and cla use 2.2 (Introduction oi Changes, Termination of Empl oymen t in Cases of Red u nd ancy): (b) Provided th at thi s sub da use sha ll app ly only to weekly full-time employees un l ess otherwi se mutually agreed upon in writi ng between the employer and the Branch Secre ta1)' of the Au stra lian Mun ici pa l, Adm ini stra tive, Clerical an d Services Union, Central and Sou thern Queensland Clerical and Adm ini st rative Bra nch, Un ion of Employees and/or the Bra nch Secre t ary of the Federated Clerks ' Uni on of Au st rali a, No rth Queensland Branch, Un ion of Emp loyees. (6) Th is Award shall not apply to any employees engaged sol ely in the delivery of newspapers. ( 7) Th is Award sha ll als o apply to contractors and/ or sub- contractors and their empl oyees performing or executing any work lO wh i ch th is Awa rd ordi narily is appli ca ble. (8) As to the employers named in Schedul e 2 to th i s Awa rd, the provisions of the Award are modified in accordance with the req uiremen ts of the individual order li sted in su ch Schedule.". 3. In subclause (3) oi clause 2.5 (P reierence) - (a) by deleting from the fi rst paragraph th e words and brackets "Federated Cle rk s' Un i on of Austra lia (Central and Sou th ern Queensl and Bra nch) Un ion of Em ployees " wh ere they appear on the third, fourth and fi fth lin es and inserting th e ioll ow ing in lieu thereof:- "Austra l ian Municipal, Admin i stra tive, Clerical and Services Un ion. Central and Southern Q ueen sla nd Clerical and Adm inistra tive Branch, U nion of Employees"; and (b) by deleting from prov ision (a)(i i) the number "13.53" where it appears on the fourth line and ,nserling the number "255" in lieu thereof. 4. By del et i ng paragraph (ii) of provision (d) of su bcl ause (3) of cla use 3.2 (C l ass iri ca tion Structures) and inserting the foll ow ing in li eu thereof:- "(ii) The empl oyer shal l have comp leted the classification p rocess by 14 January 1994.". 5. In subcl ause {li of cl ause 3.4 (W ages ), by del et ing the wages and note under the heading "Clerks" an d i nse rting th e iol lowing in lieu thereof:- "C /erks The foll owing ra tes shall apply to the un dermentioned class ifications in the So uthern Division (Eastern District) - (The wage rate for clerks employed under the p re vious New En tran t Cl ass ii ica ti on (without all owancesi as at 24 August 1993 was $367.10 per week). NOTE: Until the final Minimum Ra tes Ad j ustment h as been awarded th e wage rates under this Award effective from 30 Augus1 1993 shall be con1ained in Schedule 7. Schedule 6 contains the wage rates that applied under the Clerks and Switchboard Attendants in Reta il Stores Award - S1a1e, as at 29 August 1993. As no existing employee employed by 1he employer prior 10 29 August 1993 is to suffer any red uction in ordinary time earn ings as a result of this Award, employers may be required to refer t? both Schedul es 6 and 7 in determining the appropri ate rate or pay to an employee empl oyed by that employer pri or 10 30 August 1993.". 6. Sy adding a n ew clause 3.7 (C lerks On ly - H igher Dul i es Payment) as follows:- "3.7 Clerks Only - H igher Duties Paym ent An employee who is called upon 10 perform work a1 a level above their current cl ass ified level for a period of mo re th an two d ays, sha ll be paid at the minimum awa rd rate prescribed fo r tha t higher level for the whole pe riod involved on such higher level dut ies.".
