Adj ustmen t. Arising from the se ad j us tmen ts certai n
' Ex cess Payments' have al so been id en tified and are
payable to employees en gaged in such cl assi fications as
part oi their Agreemen t Ra te (See cl ause 3.3A -
Trans lat ion to New Cl ass ification Structure). These
'Excess Paym en ts ' are not subj ec t to absorption of th e
safety net ad j us tm en t. Such ' Ex cess Paym ent' shafl not
h ave any su bsequent percen t age based wage i ncrease
appli ed to it.
No te 2 The supplementary payment at each c!assiiication level
i nclud es an $8.00 adjustment reflecting the application
of th e arbitrated safety net ad justment princ iple
enunciated in the Fe bruary 1994 Review of Wage
Fixing Pr inciples. Consistent w ith the requiremen ts of
that pri nci ple, b ut subject to clause 3.3A, the $8.00
saiety net adjustmen t is absorbable to the extent of any
equivalent amount in r ates of pay - whether
overaward, award, industrial agreement or cer ti fied
ag reement - in excess of the min imum rates
(baseiclassifi ca ti on rate an d supplementary payment)
prescribed in accordan ce w i th the October 1989 State
Wage Case decision an d ad j us te d in accordan ce wi th
the July 199 1 State Wage C ase deci si on.

'Overaward' Payment is deiined as the amount i n
r ates of pay wh ich an employee would receive in
excess of the minimum award wage as prescribed
in this Agreement for the classi fica tion in wh ich
such employee i s engaged wh i ch appli ed
i mmediately prior to the date of operation ot this
variation:
Prov ided that this defin i:ion shall exclude overti me, sh ii t
allowan ces, penalty r ates, expen se related al lowances,
industry allowan ces, disabili ty al lowan ces, vacation
a ll owan ces, special rates or allowances. responsibility
a ll owances, or an y other ancil lary payments of a like
nature described by this Agreement.
Note 3 The percentage relativi ti es colu mn rela tes to perc en tages
app lyin g beiore the application of the $8.00 arbitrated
saiety net adJustrnen t rnade In accordance w i th the
February 1994 Review of Wage Fixing Principl es . Th e
percentage relat iv ities are based on a base rate and
suppl ementary payment total ling $417.20 per week.
The percent age re lativi ti es colu mn should also be
ap plied by excluding amounts p aya bl e to employees
pursuant to clau se 3.3A (Transla tio n to New
Cl assi fication Structure).".
