THES E matters com ing on for hea ring before the Comm i ss ion at
Bri sban e on 14 and 17 February 1994, th is Commi ssion doth
order that the sa id Award be vari ed as follows as from the seventh
day of March, 1994 :-
By deleti ng cl au se 7 (Wages} an d inserting t he foll ow ing in
li eu thereof:-
"Wages
7.(1 ) Adult s - Subject to clause 6 hereof, the minimum
ra tes oi wages to be pa id to the undermen tioned level s of
employees shall be as fol lows: -
The new clas si ficat ion st ru c tu re expres ses th e interim total
award ra te payab l e, being the combin at ion of t he interim
base rate (incl udi ng broadbanding adjustmen ts ) and the first
3 minimum rates ad j ustments and the $8 sa fe ty net
adj us tment. Suc h minimum rates ad j us tm en ts are to be
absorbed into overaward paymen ts where such payments are
being mad e. Th e Interim Total Award ra te als o includes
increases and adj us tments ari sing as a resuh of the second
tier adj ustm en ts and all st ructura l effici en cy adjustmen ts.
Append ix A attach ed to this Award lists am ounts in volved in
broadbanding. Such amounts a re to be absorbed to the
extent of eq ui va lent overaward payment s.
' Ov eraward Paym en t' is defined as the am ount (whether it be
termed 'overaward paymen t', 'attendan ce bon us· , 'servi ce
increment' or any term w ha tsoev er) wh ic h an empl oyee wou ld
receive in excess of the 'Award Wage' wh ich appli ed immediately
pri or to the d ate of operation ol any broadbanding or m ini mum
rates ad j ust ment awarded by the Commi ss ion for the classificati on
in wh ich the employee is e ngag ed:
Provided tha t such pa yment shall exclude ove ,t ime sh i ft
allowances, penalty ra tes, allowances, fa res and travel ling ti me
all owan ces an d any other ancillary payment of a li ke nature
prescribed by this Awa rd.

• • Ex cc;s Payment - In addi tion to the ba se ra te, ex cess
payments presC'ribed above are to be paid for all purpo ses of the
Award. Such excess payment shall not have any \ubseq uent
percentage based wage increase applied to it. Such excess
payment shall be pa id to al l ex isting and future employees.

level includes an $8 . 00 adjustment reflec11ng the applicat ion of
th e arbitrated safety net ad justment pri nciple enuncia te d in the
Feb ru ary 1994 Review of Wage r ixing Principl es. Con sis tent with
the requiremPnts of that Pnnc1ple the SB .00 safety net adjustment
1s .ibsorbable to the ei,.tent of any equivalent amount m rates of
pay - wh et her over-award, awa rd, industrial agreement or
certi fied agreem en t - in ex c,>,ss of the mini mL1m r at ~s
{classificati on rate and supplementary payment) prescribed 1n
ac cordance v. ith the October 1989 Stat e Wage Case decision and
ad 1u sted m accordancP with the Ju ly 1991 State Wage Case
dec1~i on.
(2) Juniors - The minimum weekly ra tp oi wag es payable to
Junior emplo)eeS employed 1n clubs shall be calculated as
fol lo ws:-

sa lr or distribution or alcohol sha ll be paid the adul t rate
prescribed in su bclause ( l ) hereof /or the work performed.
(3) Cakulat,on of Junior Rates - Junior rates shall be
calcu l ated in multipl es of ten cen ts with any result 01 five cents or
more being tak en up to the ne xt hi gh es t ten c en t multiμl e. ".
