R 12-5 of of 1990 and 8648 of 1993) H OTEL EMPLOYEES' AWARD - SOUTH-EAS TERN D IVISI ON COMMISSIONER BO UGOURE 17 February 1994 VARIATION THESE matters coming on for h ea ring before Ihe Commissi on at Brisbane on 14 and 17 February 1994, this Commission doth o rd er that the sa id Award be varied as follows as from the fourth day of Ap ril, 1994:- By del et ing clause 5 (Wage s) and inserting the followi ng in lieu thereof:- "Wages 5. ( 1) Subject to clause SA hereof t he minimum r ates of wages to be paid to the undermentioned level s of employees shall be as follows:- The new class ification structure expresses the interim total award r ate payable, being the combinati on of the interim ba se rate (including broad ba nding ad j ustments) and the first 3 minimum rates adju st ments and Ihe $8 safety ne t adj ustment. Such mi ni mum ra tes adj ustments are to be absorbed into overaward payments where such paym en ts are be ing made. Such amounts are to be absorbed tu the ex tent of equivalent overaward payments. 'Overaward Paymen t' i s defined as t he amoun t (whether it be Iermed 'overaward payment', 'attendance bonus', 'servi ce increment' or any term whatsoever) wh ich an employee would receive in excess of the 'Award Wage' which appli ed immediately prior to the da re of opera ti on of any broadban di ng or mi nimum rates adjustment awarded by the Commi ss ion for the class i ficati on in which the employee is engaged: Provided th at such payment shall excl ude overtime shift allowances, pe nalty rates, allowances, fares and travelling time allowances and any other ancillary paymenl of a like nature prescribed by this Awa rd. Excess Payment - In addi tion to th e base ra re, excess payments pre scr ibed above are to be paid for all purpo ses of the Aw ard. Such excess payment shall no l have any su b seq uent percen tage b ased wage increase ap plied to it. Such excess payment sh all be paid to all exi sti ng and future employees. The inIe rim supplementary p ay ment at each class ification level includes an $8.00 adjustment reflecting Ihe appli ca tion of the arbit rat ed safety n et adj us tment pr inc iple en u nci ated in the February 1994 Rev iew of Wage Fixing Pri nc iples. Consistenl with the requirements of Ihat Pr inciple, the $8.00 sa fety net ad j ustment is absorbable to the ex tent of any eq uivalent amounl in rat es of pay - whether over-award, award, industrial ag reement or certi fi ed agreement - in excess of the minimum ra t es (class ification rate and supplementary payment) pre scr ibed in accordance w it h the October 1989 Stat e Wage Ca se decisi on an d adjusted in accordance with t he Ju ly 1991 State Wage Case decision. (2) Juniors - The minimum rates of wages for j unior emp loyees (as defined) shall be the undermen tioned percentages of t he rate p resc ribed for the class ifications appropria te to the work performed for the area in wh ich the wo rk is pe rformed:- Under 19 years of age . . .. . . . . .. .. . 19 an d under 20 years of age 20 an d under 21 years of age Pcrccnrage % 70 80 90 and !hereafter at the appropri ate ra te p re scribed for adul t employees for the cla ss of work being performed: Provid ed t ha t Jun ior employees engaged as at 2 Ju ly 1990 sha ll not have th ei r m inimum re munerati on reduced as a r esu lt of removing the ge nder bias from Ih is cl ause. (3) Calculation of Junior Rates - Junio r ra tes shall be ca lculated in mu l ti ples of ten cents with any resu lt of five cen ts or more being taken up to t he next highest ten cen t m ulli ple. (4) Casual Employees - Casua l employe es shal l be paid one-fortieth of t he rate prescribed for the class of w ork that they are performing per hour pl us the fol l ow ing loadings:- (i) 50 % for work performed Monday to Friday i nc l us ive; (ii) 75% for work performed on Saturdays; (iii) 100% for wo rk performed on Sund ays; (iv) 150% for work performed on Statutory Ho lidays. Casual employees shall be pa id as for a minimum of two ho urs per engagemenl but provided thal on Sta lutory Ho lidays the mini mum period for each engagement shall be four hours.".
