No. 123/2003 Outworkers (Improved Protection) Act 2003 Outworkers (Improved Protection) Regulations 2003 The Governor in Council makes the following Regulations: Dated: 21 October 2003 Responsible Minister: ROB HULLS Minister for Industrial Relations SUDHA KASYNATHAN Acting Clerk of the Executive Council 1. Objectives The main objectives of these Regulations are— (a) to prescribe the content of the written statement with respect to principal contractor liability; (b) to make provision for the form of permits issued to officials of the Textile Clothing and Footwear Union of Australia (Victorian Branch). 2. Authorising provision These Regulations are made under section 65 of the Outworkers (Improved Protection) Act 2003. 3. Commencement These Regulations come into operation on 1 November 2003. -- 2 of 4 -- Victorian Legislation and Parliamentary Documents S.R. Definitions In these Regulations— "Act" means the Outworkers (Improved Protection) Act 2003; "Union" means the Textile Clothing and Footwear Union of Australia (Victorian Branch). 5. Written statement by subcontractor For the purposes of section 13(1) of the Act, a written statement by a subcontractor must— (a) identify the contract to which the statement relates; and (b) state the period to which the statement relates; and (c) state whether all remuneration payable to relevant outworkers for work under the contract done during that period has been paid; and (d) state the date on which payment to which the statement relates was made to the relevant outworkers; and (e) be signed and dated by the subcontractor. 6. Permit to Enter and Inspect Premises For the purposes of section 45(2) of the Act— (a) the prescribed form of the permit is set out in the Schedule; and (b) the prescribed content is the content of that form. __________________ r. 4 -- 3 of 4 -- Victorian Legislation and Parliamentary Documents S.R. No. 123/2003 Outworkers (Improved Protection) Regulations 2003 3 SCHEDULE Regulation 6 Outworkers (Improved Protection) Act 2003 PERMIT TO ENTER AND INSPECT PREMISES This permit is issued to (name), an officer/employee* of the Textile Clothing and Footwear Union of Australia (Victorian Branch). The holder of this permit is entitled, while the permit is in force, to exercise the powers and functions given to the holder of this permit by Division 2 of Part 4 of the Outworkers (Improved Protection) Act 2003. The permit remains in force for 3 years from the date of this permit in accordance with section 45(3).
