No. 141/2003 Public Records Act 1973 Public Records Regulations 2003 The Governor in Council makes the following Regulations: Dated: 25 November 2003 Responsible Minister: JOHN THWAITES Minister for Victorian Communities SUDHA KASYNATHAN Acting Clerk of the Executive Council 1. Objectives The objectives of these Regulations are— (a) to set conditions under which members of the public may inspect public records and use facilities provided by the Public Record Office; and (b) to set fees for making and supplying copies of public records and other services provided by the Public Record Office; and (c) to provide for other matters authorised by the Public Records Act 1973. 2. Authorising provision These Regulations are made under section 23 of the Public Records Act 1973. 3. Commencement These Regulations come into operation on 26 November 2003. -- 2 of 6 -- Victorian Legislation and Parliamentary Documents S.R. No. 141/2003 Public Records Regulations 2003 2 4. Conditions of use of public records and facilities (1) A member of the public inspecting a public record or using facilities provided by the Public Record Office to the public must— (a) refrain from behaving in a manner offensive to other users; and (b) use the public record in accordance with the conditions set by the Keeper of Public Records from time to time for the preservation and security of the record; and (c) refrain from using a camera, scanner, tape recorder or other copying or transcription device using any technology in the vicinity of a public record without first receiving the approval of the Keeper of Public Records. (2) A person who does not comply with sub- regulation (1) may be requested to leave the premises of the Public Record Office. 5. Fees The fees to be charged for making and supplying a copy of a public record and providing other services are set out in Schedule 1. 6. Notice of possession of a prescribed record For the purposes of section 16(2) of the Public Records Act 1973, a notice of possession of a prescribed record must be in the form in Schedule 2. __________________ r. 4 -- 3 of 6 -- Victorian Legislation and Parliamentary Documents S.R. No. 141/2003 Public Records Regulations 2003 3 SCHEDULES SCHEDULE 1 Regulation 5 FEES FOR MAKING COPIES OF PUBLIC RECORDS Photocopying $0.65 per page Copies of microfilm, microfiche or microfilm cards made by use of self operated copier in the Reading Room $0.95 per page Copies of microfilm, microfiche or microfilm cards other than by use of self operated copier $5.50 per page Digital copies of documents $15.00 per document FEES FOR PRIORITY SUPPLY OF COPIES OF PUBLIC RECORDS (ADDITIONAL TO FEES FOR MAKING COPIES) Fee for supply of copies made by staff of the Public Record Office— supply on day of request supply next day $15.00 per 20 copies or part of 20 copies $7.50 per 20 copies or part of 20 copies FEES FOR OTHER SERVICES Fee for providing a certificate under section 22(2) of the Public Records Act 1973 $5.00 per certificate Fee for inspection of a public record for the purpose of certifying a true copy of or extract from a public record under section 22(2) of the Public Records Act 1973 $12.50 per copy or extract to be certified __________________ Sch. 1 -- 4 of 6 -- Victorian Legislation and Parliamentary Documents S.R. No. 141/2003 Public Records Regulations 2003 4 SCHEDULE 2 Regulation 6 NOTICE OF POSSESSION OF A PRESCRIBED RECORD I, (name) of (address) (occupation) declare that I am the owner of (describe record in full) which has been declared a prescribed record under section 16(1) of the Public Records Act 1973. The record is (tick one)  in my custody at (address)  not in my custody and I believe that (name) of (address) (occupation) has custody. No. 141/2003 Public Records Regulations 2003 5 ENDNOTES The Public Records Regulations 1992 (S.R. No. 297/1992) as extended by the Subordinate Legislation (Public Records Regulations 1992 - Extension of Operation) Regulations 2002 (S.R.
