(2) Preference as abovemention ed sha ll, in all cases, be subject to the following condi tions:- (a) an employer is required to gi ve preference to a member of an Industrial Organisation over another person only wh en all factors relevant to the particular case are otherwise equal; {b) an employer is not requ ired to give preference to a member of an Industrial Organisation over a person in respect of whom there i s in force a certificate under sec tion 255 of t he Industrial Relations Act 199 0.
