Queensland Branch AND Commissioner for Railways (No. B85 of 1991) RAIL WAY AW ARD - ST AT E COMMISSIONER FISHER VARIATION 30 May 1991 THIS matter coming on for hearing before the Commission at Brisbane on 30 Mav 199 l. this Commission do th order that the said Award be varied as follows as from the thirtieth day of May. 199 1:- l. By deleting subclause (7) " .Minimum Payment" of clause 25 (Shunters) and renumbering subclauses (8) and (9) as subclauses (7) and (8). 2. By deleting subclause (4) "Call-outs" of clause 52 (OYe rtim e) and renumbering subclauses (5) to (8) as subclauses (4) 10 (7). 3. By deleting subclause (4) "Call-out s" of clause 60 (Overt ime) and renumbering subclauses (5) to (7) as subclauses (4) to (6). 4. By deleting subclause (3) "Call-outs" of clause 67 (Overtime) and renumbering subclauses (4) and (5) as subclauses (3) and (4). 5. By deleting subclause (6) of clause 86 (General - Al l Employees) and inserting the following in lieu thereof:- "(6)(a) Pass i ve Duty.- Any employee other than a station mast er who after finishing dut y for the da y is required 10 remain at such employee's home for passive duty shall be paid a minimum of one hour's pay for each occasion such employee so remai ns a t home: Provided that a wages employee who is required to remain at home for passive duty on Saturday and /or Sunday shall be paid a minimum of two hours· pay at the rate applicable to the day for each of these days such employee so rema ins at home. (b)(i) Special Call Ow. - If an employee (other than a Trainman) is called out at any time and attends for duty then such an emp loyee shall be paid a minimum payment of four hours at ordinary rate pl us the penalty payment applicable to the particular day for actual hours worked. (ii) Report for Duty as Rosiered.- If an employee repons for du ty as rostered then such employee sha ll be entitled 10 a mi nimum payment of four hours. at the rate applicable 10 the particu la r day.".
