Case law · Queensland · 1991
[1991] RSLT 9 RETAIL SHOP LEASES ACT 1994 In the matter of Dispute No.101 of 1990 R A & P J BULLOCK - Claimant - and - GENERAL FORD (AUST) PTY LIMITED - Respondent DECISION Given on 27 March 1991, in Brisbane -- 1 of 2 -- Bullock-v-General Ford Decision - Page 2 THE CHAIRMAN: As a matter of law, I'm going to direct this Tribunal that, once a matter has come before the Tribunal, all disputes existing at that time must be determined, and if they are not determined, then they can't come up before the Tribunal again. You can't have a second bite at the same cherry on a new basis. ..... THE CHAIRMAN: I direct the Tribunal as a matter of law we cannot consider this matter, because the matters in dispute, according to what Mr Bullock has just told me, arose in September 1985. The matter came before the Tribunal, and the decision was given in July 1986. One assumes that the Tribunal dealt with the matters which had been raised. I certainly can't re-open them, sit as a sort of Court of Appeal on the decision which they made. Thank you. --------- -- 2 of 2 --
