-v-
The Valuer-General
DECISION
LAND COURT,
BRISBANE.
7th December, 1990.
Four (4) appeals lodged by Brian Tone Dillon against valuations of
certain parcels of land within the City of Rockhampton came before the Land Court
on 30th October, 1990 for hearing and determination. Brief details are:-
AV90-74 - Roll No. 5140 - 7416 square metres - Valuer-General's
valuation $8,000. Appellant's value $100.
AV90-75 - Roll No. 8817 - 1012 square metres - Valuer-General's
valuation $11,500. Appellant's value $100.
AV90-76 - Roll No. 17184 - 2.019 hectares - Valuer-General's
valuation $39,000. Appellant's value $800.
AV90-77 - Roll No. 699 - 1265 square metres - Valuer-General's
valuation $28,000. Appellant's value $2,000.
Mr Dillon attended the hearing and produced much evidence in
support of his appeals. He tendered copies of some 20 documents, none of which
are relevant, in so far as the determination of the value of the appeal lands is

concerned. Most of the material is copies of letters to and from political leaders.
What is required if owners are to discharged the onus resting upon them under the
provisions of Section 161 (3) of the Valuation of Land Act, is some relevant evidence
in support of the grounds of appeal. Examples could be submissions as to
inappropriate relativity in unimproved values, reliance upon relevant sales evidence
etc.
The respondent Valuer-General did not furnish any evidence, and his
action in doing so is justified. It is for owners to satisfy the Court that the Valuer-
General is in error in fixing valuations at a certain level and Mr Dillon certainly has
not achieved this goal.
All appeals are dismissed and the following determinations are made -
AV90--74 - Roll No. 5140. The Valuer-General's valuation of $8,000
is affirmed.
AV90--75 - Roll No. 8817. The Valuer-General's valuation of
$11,500 is affirmed.
AV90--76 - Roil No. 17184. The Valuer-General's valuation of
$39,000 is affirmed.
AV90--77 - Roll No. 699. The Valuer-General's valuation of $28,000
is affirmed.
