QUEENSLAND INDUSTRIAL RELATIONS COMMISSION
Industrial Relations Act 1999 – s. 278 – application for arrears of wages
David Francis Cox AND Wax Artex Pty Ltd (No. W102 of 2003)

In its decision of 7 April 2004, the Commission found in favour of the applicant albeit not to the extent claimed.

Consequently the Commission directed the applicant to recalculate the amount claimed based on the decision and to submit a revised draft order to the
Commission and to the respondent within 7 days.
The respondent was given a further 7 days to raise objections to the revised calculations.
The applicant has complied with the requirement of the Commission and the respondent has written to the Commission raising issues with respect to the
decision.
The opportunity provided to the respondent was to review the calculations of the applicant, not to revisit the decision. Unfortunately for the respondent it
was unrepresented during the hearing and the issues now raised by it amount to further submissions on issues already determined. The respondent has
not challenged the calculations submitted by the applicant. The following order sought is granted.
That Wax Artex Pty Ltd pay to Zhanna Swain the amount of $3,662.41 in respect to unpaid wages for the period between 24 September and 17
November 2001. That such amount be paid no later than 22 days from the date of release of this further decision.
Appearances:
D. K. BROWN, Commissioner. Mr D. F. Cox for the Department of Industrial Relations.
