NORTHERN TERRITORY OF AUSTRALIA COMPETITION POLICY REFORM (NORTHERN TERRITORY) REGULATIONS 2026 As in force at 24 July 2026 Table of provisions 1 Title .................................................................................................. 1 2 Commencement .............................................................................. 1 3 Authorisation.................................................................................... 1 4 Repeal ............................................................................................. 2 ENDNOTES -- 1 of 4 -- NORTHERN TERRITORY OF AUSTRALIA ____________________ As in force at 24 July 2026 ____________________ COMPETITION POLICY REFORM (NORTHERN TERRITORY) REGULATIONS 2026 Regulations under the Competition Policy Reform (Northern Territory) Act 1996 1 Title These Regulations may be cited as the Competition Policy Reform (Northern Territory) Regulations 2026. 2 Commencement These Regulations commence on the day after the day on which they are made. 3 Authorisation (1) For section 39 of the Act, the following conduct engaged in by an authorised person in this jurisdiction is specifically authorised for the purposes of section 51 of the Competition and Consumer Act and the Competition Code: (a) conduct in negotiating and entering into a government gas industry contract; (b) conduct giving effect to or authorised under a government gas industry contract; (c) providing information relating to a government gas industry contract or proposed government gas industry contract to another authorised person. (2) Anything authorised by subregulation (1) is authorised only to the extent to which the conduct would otherwise contravene Part IV of the Competition and Consumer Act or the Competition Code. (3) In this regulation: authorised person means any of the following: (a) the Minister; -- 2 of 4 -- Competition Policy Reform (Northern Territory) Regulations 2026 2 (b) the Territory; (c) a person acting for or on behalf of the Territory; (d) a Government owned corporation; (e) the shareholding Minister of a Government owned corporation as defined in section 3 of the Government Owned Corporations Act 2001; (f) a person acting for or on behalf of a Government owned corporation. contract includes an arrangement or understanding. gas means gas in any form and includes products derived from gas. government gas industry contract means a contract, including the assignment, novation or variation of a contract, to which the Territory or a Government owned corporation is a party and that relates to either or both of the following: (a) the supply, processing, storage, transportation or disposal of gas; (b) infrastructure or services related to, or the administration of, any of the activities mention in paragraph (a). Examples for definition government gas industry contract 1 A gas supply agreement. 2 The variation of a gas processing contract.
