No. 115/2002 Road Safety Act 1986 Road Safety (Drivers) (Demerit Points) Regulations 2002 The Governor in Council makes the following Regulations: Dated: 29 October 2002 Responsible Minister: PETER BATCHELOR Minister for Transport HELEN DOYE Clerk of the Executive Council 1. Objectives The objectives of these Regulations are to amend the Road Safety (Drivers) Regulations 1999 (a) to amend the demerit points which apply to certain speeding offences; and (b) to provide for demerit points to be incurred for other offences. 2. Authorising provision These Regulations are made under section 95 of the Road Safety Act 1986. 3. Commencement These Regulations come into operation on 15 December 2002. -- 2 of 7 -- S.R. Substitution of Table 301 In regulation 301 of the Road Safety (Drivers) Regulations 1999 1 for Table 301 substitute— "Table 301 Column 1 Description of Offence Column 2 Reference Column 3 Demerit points Driving or being in charge of a motor vehicle with more than the prescribed concentration of alcohol in the person's blood, where, under section 50(1), 50(1AB) or 89C(1) of the RSA, the person's driver licence or permit has not been cancelled for the offence RSA 49 10 Exceeding speed-limit by 45 km/h or more RR 20 8 Exceeding speed-limit by 35 km/h or more but less than 45 km/h RR 20 6 Exceeding speed-limit by 25 km/h or more but less than 35 km/h RR 20 4 r. 4 -- 3 of 7 -- S.R.
