CATCHWORDS: GENERAL ADMINISTRATIVE MATTERS Queensland Civil and Administrative Tribunal Act 2009 (Qld), s 48 Body Corporate and Community Management Act 1997 (Qld), s 229 APPEARANCES & REPRESENTATION: This matter was heard and determined on the papers pursuant to s 32 of the Queensland Civil and Administrative Tribunal Act 2009 (Qld) REASONS FOR DECISION [1] Robert William Forrester, the applicant, filed an application to resolve a complex dispute pursuant to the provisions of the Body Corporate and Community Management Act 1997 (Qld) (‘the Act’) in the Tribunal on 17 February 2026. The alleged dispute involves a claim against Pacific Pines Central CTS 30767 (‘Body Corporate’) regarding the work that was undertaken on the roof of his unit which is part of CTS 30767. [2] No response has been received from the Body Corporate. [3] There may be a jurisdictional issue to decide before the substantive issues regarding the application can be considered or determined. That is whether the application involves a complex dispute pursuant to s 229(2) of the Act or whether the application involves a dispute which can be resolved through the dispute resolution process pursuant to s 229(3) of the Act. [4] Member Wilson made orders on 9 March 2026 for the parties to file submissions in the Tribunal for the above issue to be determined by the Tribunal before the application can proceed. -- 1 of 2 -- 2 [5] Both parties have not complied with the timelines set out in the Tribunal order.
