No. 109/2001 Cemeteries Act 1958 Cemeteries (Incorporation of Trusts) (Further Amendment) Regulations 2001 The Governor in Council makes the following Regulations: Dated: 16 October 2001 Responsible Minister: JOHN THWAITES Minister for Health HELEN DOYE Clerk of the Executive Council 1. Objective The objective of these Regulations is to— (a) incorporate an additional 4 cemetery trusts; and (b) abolish 3 cemetery trusts; and (c) change the name of a number of cemetery trusts and the name of the public cemeteries they administer. 2. Authorising provisions These Regulations are made under sections 3 and 92 of the Cemeteries Act 1958. 3. Principal Regulations In these Regulations, the Cemeteries (Incorporation of Trusts) Regulations 19951 are called the Principal Regulations. -- 2 of 7 -- S.R. Additional cemetery trusts incorporated In the Schedule to the Principal Regulations— (a) after the item relating to The Bambra Cemetery Trust— (i) in column 1 insert "The Bannerton Cemetery Trust"; (ii) in column 2 insert "Bannerton Public Cemetery"; (b) after the item relating to The Northcote Cemetery Trust— (i) in column 1 insert "The Numurkah- Wunghnu Cemetery Trust"; (ii) in column 2 insert— "(a) Numurkah Public Cemetery (b) Wunghnu Public Cemetery"; (c) after the item relating to The Whitfield Cemetery Trust— (i) in column 1 insert "The Whroo Cemetery Trust"; (ii) in column 2 insert "Whroo Public Cemetery"; (d) after the item relating to The Yarram Cemetery Trust— (i) in column 1 insert "The Yarrawonga & District Cemetery Trust"; (ii) in column 2 insert— "(a) Bundalong Public Cemetery (b) Burramine Public Cemetery (c) Peechelba Public Cemetery r. 4 -- 3 of 7 -- S.R. Abolition of cemetery trusts (1) A cemetery trust listed in column 1 of the table is abolished and all its assets and liabilities are transferred to the cemetery trust listed in column 2 of the table opposite the first cemetery trust. No. 109/2001 Cemeteries (Incorporation of Trusts) (Further Amendment) Regulations 2001 4 (a) in column 1 omit "The Campaspe Shire Cemeteries Trust"; (b) in column 2 omit "Whroo Public Cemetery". (3) In the Schedule to the Principal Regulations, in the item relating to the Moira Cemeteries Trust— (a) in column 1 omit "Moira Cemeteries Trust"; (b) in column 2 omit— "(a) Bundalong Public Cemetery (b) Burramine Public Cemetery (c) Numurkah Public Cemetery (d) Peechelba Public Cemetery (e) Wunghnu Public Cemetery (f) Yarrawonga Public Cemetery". (4) In the Schedule to the Principal Regulations, in the item relating to the Tol Tol Cemetery Trust— (a) in column 1 omit "The Tol Tol Cemetery Trust"; (b) in column 2 omit "Tol Tol Public Cemetery". 6. Change of name of Campbell's Creek Cemetery Trust (1) In the Schedule to the Principal Regulations, in the item relating to The Campbell's Creek Cemetery Trust— (a) in column 1, for "The Campbell's Creek Cemetery Trust" substitute "The Castlemaine Public Cemetery Trust"; (b) in column 2, for "Campbell's Creek Public Cemetery" substitute "Castlemaine Public Cemetery". r. 6 -- 5 of 7 -- S.R. No. 109/2001 Cemeteries (Incorporation of Trusts) (Further Amendment) Regulations 2001 5 (2) The trust whose name is changed by sub- regulation (1)(a) is the same body after as before the change. 7. Change of name of Moe Cemetery Trust (1) In the Schedule to the Principal Regulations, in the item relating to The Moe Cemetery Trust— (a) in column 1, for "The Moe Cemetery Trust" substitute "The Moe Memorial Park Trust"; (b) in column 2, for "Moe Public Cemetery" substitute "Moe Memorial Park". (2) The trust whose name is changed by sub- regulation (1)(a) is the same body after as before the change. 8. Administration of Gippsland Memorial Park & Cemetery In the Schedule to the Principal Regulations, in the item relating to The Traralgon Cemetery Trust, in column 2, for "Traralgon Public Cemetery" substitute "Gippsland Memorial Park & Cemetery". ═══════════════ r. 7 -- 6 of 7 -- S.R.
