No. 35/2001 County Court Act 1958 County Court (Bailiff's Fees) (Amendment) Order 2001 The Governor in Council makes the following Order: Dated: 24 April 2001 Responsible Minister: ROB HULLS Attorney-General HELEN DOYE Clerk of the Executive Council 1. Objective The objective of this Order is to increase the fees payable to the bailiff. 2. Authorising provision This Order is made under section 28 of the County Court Act 1958. 3. Commencement This Order comes into operation on 1 May 2001. 4. Fees For Order 3 of the County Court (Bailiff's Fees) Order 19961 substitute— "3. Fees to the bailiff -- 2 of 5 -- S.R. No. 35/2001 County Court (Bailiff's Fees) (Amendment) Order 2001 2 The fees payable for work performed by the bailiff are as set out in the following Table— TABLE No. Item Amount 1. (a) For execution or attempted execution of every warrant or writ or other process (except for a warrant of possession, writ of possession or a combined warrant) $158.00 1. (b) For execution or attempted execution of every warrant of possession or writ of possession, for the first two attempts $200.00 1. (c) For execution or attempted execution of every warrant of possession or writ of possession, after the first two attempts, for each 2 further attempts $169.00 1. (d) For execution or attempted execution of every combined warrant $250.00 2. Where a warrant, writ or other process for which a fee is payable under item 1 specifies more than one address at which execution is requested, for each additional address specified $70.00 3. On the renewal of, or redirection of any warrant, writ or other process or the receipt of instructions to proceed with execution after the party at whose request the warrant was issued has earlier provided instructions to withhold or withdraw from execution $70.00 No. Item Amount r. 4 r. 4 -- 3 of 5 -- S.R.
