No. 17/2001 County Court Act 1958 County Court (Chapter I Amendment No. 4) Rules 2001 A majority of the Judges of the County Court makes the following Rules: 1. Object The object of these Rules is to make miscellaneous amendments to the Principal Rules. 2. Authorising provisions These Rules are made under section 78 of the County Court Act 1958 and all other enabling powers. 3. Commencement These Rules come into operation on 1 March 2001. 4. Principal Rules In these Rules, the County Court Rules of Procedure in Civil Proceedings 19991 are called the Principal Rules. 5. Amendment to composition of Damages List In Rule 34A.03(c)(iii) of the Principal Rules for "section 135A" substitute "sections 134AB or 135A". -- 2 of 5 -- S.R. Amendment to composition of Divisions of Damages List (1) In Rule 34A.04(2) of the Principal Rules, for "or the Damages (Applications) Division" substitute ", the Damages (Applications) Division or the Damages (Serious Injury) Division". (2) In Rule 34A.04(5) of the Principal Rules, after "Rule 34A.03(c)(i), (iv) and (v)" insert "and any other proceeding commenced by originating motion, other than a proceeding referred to in paragraph (6) or Rule 34A.06(2)". 7. Amendment of composition of Business List Rule 34A.05(b) of the Principal Rules is revoked. 8. Amendment to composition of Miscellaneous Division of Business List In Rule 34A.06(5) of the Principal Rules, after "any proceeding" insert "commenced by writ". Dated: 1 March 2001 G. R. D.
